Judge Mathis says Erik and Lyle Menendez deserve to be free men ... telling us new evidence they were allegedly molested by the father they killed totally changes things.

00:00I know right now a lot of people are talking about the Menendez brothers and possibly about
00:07them getting out December 11th, that's a possibility.
00:10I mean, how do you feel as a judge, you know, if this decision was to happen, do they deserve
00:15to get out?
00:16I know the internet is kind of like, I don't know, you know?
00:20Absolutely they should.
00:21I think what has been brought as new evidence, which is what judges should determine when
00:27resentencing or providing a retrial, that new evidence creates what we call mitigating
00:32circumstances.
00:33If they were abused sexually by their parents, then that has created a mitigating circumstance.
00:39You reduce the severity of the sentence because in many ways it was an act of self-defense.
00:48Some might interpret, I don't quite interpret as that, but I do call it mitigating circumstances.

00:55So if you were a judge in this case, how would you?
00:57They'd be going home.

01:01When they come out, do you think that Hollywood, we have space for them maybe to be stars after

01:07Like Gypsy Rose maybe.
01:08Well, I don't know if that's what, they need to get their lives together first internally
01:12and then perhaps present themselves to the world.
01:15That would be my advice to them.
01:17It's a lot that went on behind bars all these decades and they're going to have to recover
01:21from that.
