00:00Oh, just relax, your heads might get hot in what we're going to talk about today.
00:07A 10-year-old boy is being sold by his mother and partner for illegal drugs.
00:16And the boy is also getting hurt if he doesn't follow the rules.
00:20What does the law say about this?
00:23Ask me, ask Attorney Gabby.
00:30Attorney, aside from the fact that the boy is being sold by his parents for illegal drugs,
00:36and that he is also getting hurt if he doesn't follow the rules,
00:40what can happen to the parents of the boy?
00:44Of course, obviously, child abuse is what's going to happen.
00:48Not only for the physical abuse or the hurt,
00:51but even worse is the use of the boy to sell illegal drugs.
00:56This is also included in the Republic Act 9231 or the Special Protection of Children Against Child Abuse
01:02that prohibits the use of our children.
01:06But more importantly, it prohibits the use of children in drug trafficking or drug pushing.
01:13The penalty for this is up to prison correctional in its medium period
01:17to reclusion perpetua or up to 40 years in prison.
01:22More importantly, the sale of illegal drugs has a penalty of life imprisonment
01:29and a fine of up to 10 million pesos.
01:32And the maximum penalty that will be imposed
01:35if it can be proven that a minor was used as a runner of illegal drugs.
01:40Of course, if this happens, the protection of the child involved must be ensured.
01:45And if there is no relative who is obedient and will protect the child,
01:50he should be placed in the protective custody of the DSWD or another child caring agency.
01:57And eventually, the right to be a parent of that child's mother may also be removed.
02:05That child is really pitiful.
02:07Attorney, there are cases where children help in the legal life of their parents even when they are still young.
02:16What does the law say about this?
02:19Well, the law does not prohibit the help of children in the life of the family.
02:24Although as a general rule, a minor less than 15 years old should not be employed.
02:32But this is allowed, especially if this is a family business
02:36and only members of the family are involved in running it.
02:41But of course, it should not be dangerous to the health, morals and normal development of this child.
02:48And it should be ensured that the parents are educating their children.
02:53Of course, we know that there are many minors in public entertainment,
02:57such as television, radio and other media,
03:01but they need an employment contract that is guided by their parents or legal guardian.
03:08And of course, the employer should always ensure the safety of the children.
03:14There should be a work permit from the DOLE and the hours of work of the child should also be regulated.
03:20If the child is less than 15 years old, not more than 4 hours a day, not more than 5 days a week.
03:26If the child is more than 15 but less than 18 years old, not more than 8 hours a day and 40 hours per week only.
03:33The child should also not go to work overnight.
03:36The child should pack up from 8 or 10 in the evening until 6 in the morning.
03:41Remember, these children may not grow up.
03:45We should always look at their health and well-being.
03:50In any case, in our discussion of the law, we will give clarity for the peace of mind.
03:57Don't think twice.
03:59Ask me, ask the 30 Guidelines.
