00:00To discuss the hearing of the House Quad Committee on the War on Drugs of the Duterte Administration,
00:06we will talk to the former Integrated Bar of the Philippines President, Atty. Domingo Cayoza.
00:11Good morning and welcome to Balitang Hali.
00:14Good morning, Connie, and good morning to those watching the program.
00:19Atty. Cayoza, the former President Rodrigo Duterte has many confessions.
00:25But the question is, will it be used in the court here in the Philippines or in the International Criminal Court?
00:30Everything that the former President said in the Quad Comme hearing?
00:35It will be used because all of his statements, confessions, and explanations,
00:42they are material and relevant to the issue, to the complaint or to the case against him.
00:50The EJK, Crimes Against Humanity, or possibly murder,
00:57if that will be the subject of the case build-up, not only in the Philippines, but also in the ICC.
01:04So they are material and relevant. They are freely given under oath publicly.
01:09So there is no prohibition from them being used in those cases if there will be a case against him.
01:18Okay. But President Escudero also mentioned that it is hard to prove,
01:22especially if there is no one to give an example and give a testimony,
01:27details about the confession of the President that he killed six to seven people.
01:33How is that?
01:35Well, by themselves. It will not be sufficient to convict him, but it's a good start.
01:43Circumstantial evidence can be used to encourage the other witnesses who went to the scene,
01:50or the victims or their families to file a complaint.
01:55Because he himself admitted something.
01:58The only quotient that he admitted that he killed, he became a fiscal lawyer.
02:05Maybe he already prescribed. Maybe the crime that he is saying is more than 20 years.
02:10Okay. So that's it.
02:12Maybe he already prescribed.
02:14If all the hearings in the Quadcom and the Senate are over, what should be the next step?
02:21Who should file the cases here in the Philippines?
02:24Because they are saying that we should see what DOJ will do.
02:30DOJ, NBI, CHR and our criminal justice system do not need to wait to file the cases.
02:40Before filing the cases, they should build up the case.
02:43It's good. It helps that he admitted a lot of things.
02:46They are saying a lot of things. They can be used against him.
02:49They don't need to wait.
02:52The Quadcom and the Senate, under their own rules, they are supposed to submit a committee report.
02:59It can be based on that.
03:02The data, documents and testimonies can be used,
03:06either in the local courts, in our local administration of justice or in the ICC.
03:12Okay. Speaking of ICC, they are saying that they can also use the so-called murders
03:20in the basis of crimes against humanity as a whole under ICC.
03:27What do you think about that?
03:29That is true. For local cases, it needs to be connected to specific murders.
03:36But in crimes against humanity, I can generalize it.
03:41You show a trend or statistics and data.
03:45There is a police involved in that.
03:47The question is will they bring out this evidence, will they bring out these records
03:52and will the new PNP under the Bagong Pilipinas do its job to investigate and hold accountable.
04:00Not only President Duterte, but also those who used his instructions or were directly involved with the ICC.
04:09It's a challenge to our justice system.
04:12Okay. Is there a legal issue with the request of former President Duterte to assist former Senators Dilima and Rillanes?
04:20Well, it doesn't amount to threat. It's just very revealing.
04:25It shows his true nature.
04:28I mean perhaps, but it did not amount to contemptuous conduct because he apologized.
04:37We've seen that before. It's nothing new.
04:41Maybe it's part of the gesturing.
04:47Malacanang has always said that there is no jurisdiction of the ICC here in the Philippines
04:52because our laws and courts are in effect.
04:55But in the last statement of Executive Secretary Lucas Bersamin,
04:59the possibility of the Philippines cooperating with the ICC was mentioned.
05:03Another one is through INTERPOL.
05:05What will be the implication of joining INTERPOL because we are still a member of INTERPOL,
05:11although not in ICC anymore?
05:14First, it's not Malacanang or the local authorities that determine if there is jurisdiction.
05:23It's ICC and so far, ICC has ruled that it has jurisdiction.
05:27Secondly, it's clear in the Rome Statute that created the ICC to which we were signatory.
05:34The jurisdiction remains for those cases and investigations that were done before we left.
05:43The third point is what Executive Secretary Lucas Bersamin is saying that we will cooperate with INTERPOL.
05:53There's no problem with the official position of the government that we will not cooperate with ICC
06:02because the basis of INTERPOL is a different treaty or convention.
06:07We will not leave.
06:09If there is a red notice or request from INTERPOL,
06:13we are legally bound under that convention and that treaty,
06:17of which we remain to be a member and a supporter to cooperate with the police.
06:24All right. Thank you very much Atty. Domingo for the information you shared with us in the latest news.
06:30Thank you very much. Good morning to everyone.
