00:00Tell me, on one hand we have the footage of 9th May, on the other hand we have questions.
00:05Earlier PTI was questioning when the decision would be made,
00:08Pravam was questioning when the decision would be made,
00:11and now the government is also questioning why the decisions of the 9th May incidents have not been made.
00:17What is going on?
00:19Look, when we listen to the government's stance on certain things,
00:26we almost don't understand how to put it into words.
00:30Let me just elaborate on the law a little.
00:33I don't know what the government is thinking about this,
00:36but the law under which many cases of 9th May have been filed,
00:40but among them the most serious cases have been filed for anti-terrorism.
00:46There is a 1997 anti-terrorism act,
00:52in section 12 of which it is written that
00:55the investigation of any case of anti-terrorism cannot go beyond the 9th day.
01:04And when the investigation is completed within the 9th day,
01:07then the trial will not go beyond the 8th day.
01:13It will be heard day to day.
01:15This is written in the law.
01:17In fact, it is written that if a person asks for a date,
01:22whether it is a trial, prosecution or defense,
01:26then he will not be given more than two dates.
01:30And on giving both dates,
01:32the judges of anti-terrorism will impose exemplary fines on him.
01:38In such a situation, when the law says
01:41that you decide these cases within 7 days,
01:44when the investigation is being carried out by the government,
01:47when the entire mechanism of prosecution is the courts of the government,
01:52they work on the prosecution on the National Exchequer,
01:54on your tax money.
01:57In such a situation, the government can criticize the decision of a court,
02:04but I don't think it is appropriate that the government,
02:09which controls most of the things of this trial,
02:13its pace, its investigation, its prosecution,
02:17so if they say that there is a delay in this,
02:20then I think they should be asked a few more questions.
02:23It is a very strange thing.
02:24But for now, the question arises, Muneeb,
02:27that a clever prosecution has solved it.
02:29There is no delay from the prosecution.
02:31Apparently, the government is claiming
02:33that there is no delay from our side.
02:35The delay is from somewhere else.
02:36So who benefits or loses from this?
02:38Because in the 9th May cases,
02:40if there is no decision on the basis of R or Power,
02:42then the leaders of PTI are also in jail.
02:44And if there is no decision on the basis of R or Power,
02:46then the question arises on the government.
02:47So on both sides, I don't see any benefit in this.
02:49Look, what Mr. Akil has said,
02:52frankly speaking, if the prosecution has,
02:57again I will say this,
02:58look, having circumstantial evidence,
03:00connecting the dots,
03:02that is another thing.
03:03But when you go into military matters,
03:06or in matters of terrorism,
03:09there are files and FIRs.
03:11So the burden of proof becomes very severe.
03:14You have to establish beyond reasonable doubt
03:16if you have to punish someone.
03:18This is not a civil matter.
03:20So the court, either I remember,
03:23if something else has happened,
03:25then I don't know,
03:26but I think it is only the court of Gujranwala
03:28from where some punishments have been made.
03:30The rest of the 9th May cases
03:32are all over the place.
03:33People staying in jail,
03:35unfortunately, give more importance to the statement
03:38that the government does not have evidence,
03:40or the state is clueless about this matter.
03:43The courts, look,
03:45this is such a high profile case,
03:47the 9th of May,
03:48this is a matter of attack on military institutions.
03:53If you look at this frankly,
03:55if you evaluate this,
03:57then this is not a small thing.
03:59This has to be expedited
04:02and they should have been prosecuted
04:05by providing evidence at a fast pace.
04:08But if the prosecution could not be done,
04:10and the prosecution could not move forward on it,
04:13could not make a decision,
04:15could not get punishments,
04:17then with utmost respect,
04:19if we are pointing towards the court,
04:21then what flags has the prosecution put up?
04:23Either they tell us about the prosecution,
04:25now look,
04:26the JITs and the officials,
04:30they do not just get punishments.
04:32If you look at the military trials in the courts,
04:35if you observe them minutely,
04:38then they have a lot of things to corroborate.
04:42Absolutely.
04:43And here comes the question of evidence.
04:44Now I come to the question
04:46that this is not just circumstantial evidence.
04:48We have footage here.
04:50And the footage that has been released today,
04:52it has been proven that there is clear evidence.
04:56Because before this,
04:57the PTI kept complaining that there was no CCTV footage.
05:01They were like,
05:02show us the CCTV footage that you are talking about.
05:04Today, a glimpse of it has come.
05:06So this must have been presented in the court as well.
05:08It was not just released here on the media.
05:11So can this evidence not be enough for the court?
05:15Look, I will just say this much,
05:18that this evidence is of great importance.
05:21Absolutely right.
05:23And the people who are clearly visible,
05:27Yasmeen Rashid Sahiba is saying
05:29that we are going to the home of the Corps Commander.
05:31Then their defense is that I did not go inside.
05:34I told them to move back.
05:35They did not move back.
05:36Then Sheryar Afridi Sahab said,
05:40God willing, we will go to the GHQ.
05:43Then there are other people like this.
05:45Some of them are 80 to 100 people
05:47who are in the military trial.
05:49It is said in their reference
05:51that their trials are almost complete there.
05:54Those punishments are not being heard
05:56because they are prohibited by the Supreme Court.
05:58As far as the rest of the matter is concerned,
06:00it is evident that there were supporters of Tehreek-e-Insaf,
06:06people came out.
06:08It was not that Yasmeen Rashid Sahiba
06:10hired 50 people from Liberty
06:12and took them to the GHQ.
06:16There was someone who she took.
06:18There were supporters of Tehreek-e-Insaf.
06:21There were people who went there.
06:23So now there is a burden on the court as well.
06:27This is evidence that gives a clear indication
06:32that the people of Pakistan Tehreek-e-Insaf
06:35are involved in this.
