00:00Former Prime Minister Najib Razak and ex-Treasury Secretary-General Irwan Serigar Abdullah have
00:07been granted a discharge not amounting to acquittal in their International Petroleum
00:11Investment Company case.
00:13Justice Jamil Hussein said he was using his inherent powers in allowing their DNAA application.
00:20Najib and Irwan were charged in 2018 with six counts of misappropriating public funds
00:25intended for payment to IPIC, an Abu Dhabi-owned corporation.
00:29They applied for a DNAA as the prosecution had yet to supply key documents to the defence.
00:35Jamil said the prosecution had not followed procedure in delivering the documents as required
00:40under Section 51A of the Criminal Procedure Code.
00:43He said although the two were charged in 2018 and trial dates were fixed, the documents
00:48were not delivered, which was an inordinate delay.
00:51Debsi Public Prosecutor Saifuddin Hashim Musaymi said some declassified documents had
00:55been handed over, but others were withheld as they are governed by the Official Secrets
00:59Act.
