00:00Welcome to you all, I am delighted to see you for a new edition of the Média Morning.
00:23Here are the headlines.
00:24In Morocco, the House of Representatives adopts the majority the project of relative organic law
00:34to the strike with 124 votes for and 41 against.
00:44And still in the kingdom, new reform of the family code.
00:47The government has communicated this Tuesday about the project of the reform.
00:52We talk about it in this newspaper.
00:58Negotiations for a ceasefire continue.
01:01Hamas and two other Palestinian groups claim that a truce was closer than ever.
01:07The House of Representatives adopts Tuesday evening the majority the project of organic law
01:18defining the conditions and methods of exercise of the strike law as it has been modified and approved by the House with 124 votes for and 41 against.
01:28This plenary session presided by the President of the House of Representatives,
01:34has been marked by the examination of a set of amendments,
01:38two new amendments that have not been examined before within the Commission of Social Sectors of the House of Representatives.
01:46Among the main amendments proposed by the government and adopted,
01:50include the integration of domestic workers among the categories concerned by the strike law,
01:56the possibility of resorting to urgent justice to temporarily suspend a strike when it threatens public order
02:06or interrupts the minimum service, the abrogation of provisions concerning the prohibition of strikes by alternation and political strikes,
02:15as well as the suppression of the criminal lie, the most severe of articles and private crimes of freedom.
02:27And then the day after the work meeting presided by His Majesty King Mohammed VI on the reform of the family code,
02:35the government held yesterday a meeting to communicate around the project,
02:40decline the tracks of the reform of the customs.
02:44This time, the Minister of Justice, Abdelkafer Ouabi,
02:47has unveiled some valid proposals in the inheritance of daughters,
02:52which grants parents the right to donate their living to their daughters, even minors.
02:58Moroccans living abroad will be able to resume marriage without the presence of two Muslim witnesses
03:05or the maternal guard, which remains valid even after the remarriage of the mother.
03:11And the activists of civil and human rights have favorably welcomed the content of future amendments to the family code,
03:24underlining the positive messages they convey on various issues related to human rights
03:31which have been addressed in the proposals submitted to the institution in charge of the revision of the code.
03:37After the completion of the process of large consultations supervised by the institution in charge of the revision of the family code
03:50and at the end of the formulation by the Higher Council of Scholars of its legal opinion on certain proposals of the institution
03:58related to formal religious texts, a royal communiqué detailed the main axes of this revision.
04:05Today, we attended the presentation by the Minister of Justice of the new amendments to the family code.
04:13Most of the points taken into account were among our requests.
04:17This includes in particular the situation of the mother who has the custody of her children
04:21but encounters obstacles when she wishes to remarry.
04:24The new amendments have also addressed the problems encountered in the framework of judicial procedures.
04:30The amendments brought by the institution of revision are in line with the royal arbitration
04:38to the opinion of the Higher Council of Scholars as well as to the fixed control for the work of the institution.
04:44The key principle remains not to prohibit halal and not to authorize haram.
04:54These amendments respond to several problems.
04:57They also respond to the expectations of feminists.
05:00As an associative actor and feminist association, or those concerned with the issues related to women's rights,
05:06we salute this progress.
05:08The struggle continues to achieve a harmonious family, enjoying its rights and equality.
05:14The next amendments to the family code aim to realize a social project
05:19focused on reform and openness,
05:21bypassing contradictory judicial interpretations and the divergences in the interpretation of the code.
05:29And in international news, Israel evokes progress for an agreement on hostages in Gaza.
05:36Hamas has, on its part, stated that a ceasefire agreement was closer than ever.
05:41Shaima Afikri.
05:44The hope of an agreement on a hostage and a liberation of hostages in Gaza is reawakening.
05:49Discussions are moving forward, supported by the mediation of Doha and Cairo.
05:54Hamas, as well as two other Palestinian groups,
05:57the Islamic Jihad and the Popular Front for the Liberation of Palestine,
06:01have stated that a ceasefire agreement was closer than ever.
06:05The negotiations aimed at obtaining a ceasefire in the Gaza Strip are still underway.
06:15As you know, technical and procedural negotiations are currently taking place here in Doha.
06:20Other avenues are at work in different contexts in Cairo.
06:28On its part, Israeli Prime Minister Benjamin Netanyahu
06:32cautiously evoked progress for an agreement on the hostages held in the Gaza Strip since October 2023,
06:39as conditions for a ceasefire.
06:43There are progress. I don't know how long it will take,
06:46but we will continue to operate in all possible ways
06:49and will continue until we bring back all the hostages from the enemy's land.
06:55Despite intense diplomatic efforts,
06:57no truce could be concluded between Israel and Hamas
07:01since the end of November 2023, which only lasted a week.
07:05Among the main points of blockade so far
07:08was the permanent or non-permanent nature of the ceasefire
07:11and the governance of the Gaza Strip after the war.
07:16At the moment, Syria announced yesterday an agreement with all the armed groups
07:22for their dissolution, according to the new Syrian authorities.
07:26These groups will be integrated into the Ministry of Defense.
07:30Aja Ingo.
07:32However, this agreement does not concern the powerful Syrian democratic forces.
07:37This armed group, dominated by the Kurds and supported by the United States,
07:41controls vast territories in the northeast of the country.
07:44Ahmad al-Sharif, the new strongman of Syria,
07:46had said on Sunday that he would absolutely not allow weapons to escape state control.
07:53The main objective is to regularize the conscripts of the old regime,
07:57whether they are security, police or army,
07:59that they have worked in the army, intelligence, police or auxiliary troops.
08:03Weapons must be carried only by the units of the state
08:06so that they can contain any illegal action.
08:11The new authorities had informed that the next step after taking power
08:15would be the dissolution of the armed factions
08:18to integrate them into the future military institution.
08:21The army of former President Bashar al-Assad collapsed.
08:24These members are called to regularize their situation with the new authorities.
08:28Some want to reintegrate the ranks of the defense of the country.
08:34My job in the police is to serve the citizens.
08:37There is a new government now and they have opened the reconciliation
08:41and I am here to join the process.
08:43We cannot simply start new jobs from scratch.
08:47If they allow us to return to our work, the majority of us will join the ranks.
08:53The new Syrian government aims to extend its authority
08:57on the areas of northeast Syria.
08:59These areas are controlled by the Kurdish, semi-autonomous administration.
09:06In Tunisia, or in front of the court of Cassation,
09:10the French National Salute and the Tunisian Network of Rights and Liberties
09:15have organized a demonstration demanding the immediate release
09:19of political and opinion-based detainees for accusations
09:23related to the so-called conspiracy against the security of the state.
09:28Our correspondent Nejoa Besha has more details.
09:34At the call of the Tunisian Network of Rights and Liberties
09:37and the French National Salute,
09:39personalities of the opposition and civil society have gathered
09:43to demand the release of 40 prisoners,
09:47including two high-ranking leaders of the opposition
09:50who appear in front of the court of Cassation
09:53accused of conspiracy against the security of the state.
09:57According to the anti-terrorist law of 2015 and the penal code,
10:01these people are in the process of being sentenced to life imprisonment
10:04up to capital punishment.
10:08During 22 months of detention,
10:11most of the defendants have only been heard once,
10:14without any material evidence,
10:17confrontation or expertise being presented to them.
10:20In reality, this case is based solely on political consultations
10:24conducted by figures of the national opposition
10:28within the framework of their legal activities.
10:34We have come today to express our solidarity with the political prisoners
10:39and demand the release of all professional politicians,
10:43media personalities, civil society activists, bloggers
10:46and even unknown young people who are in prison
10:49on the basis of Decree 54.
10:53The effect of the so-called conspiracy against the security of the state
10:57dates back to the month of February 2023,
11:00when a number of politicians, civil society activists
11:04and lawyers were arrested on the basis of accusations
11:08of wanting to form an agreement
11:11in order to conspire against the internal and external security of the state.
11:17This is a process to demand the release of political prisoners
11:21who are accused in a trial
11:24that has now become very famous,
11:27the conspiracy trial against the state,
11:30where we find almost all political formations,
11:34the leaders of the opposition political formations.
11:37These leaders met at the end of 2022
11:40and at the beginning of 2023
11:43to try to coordinate their work
11:46and constitute a united opposition front.
11:49The answer of this regime is to put them all in prison.
11:53In a statement, the Front de Salut National
11:56firmly condemned these pursuits,
11:59which qualifies as a fair assessment
12:02that the current policy of escape forward is doomed to failure
12:06and that only a national, inclusive and decisive dialogue
12:09can resolve the double political and economic crisis.
12:15And right now, it's time for the guest of the major media newspaper, Morning.
12:21The day after the work session
12:24devoted to the revision of the Family Code,
12:27chaired by His Majesty the King Mohammed VI,
12:30the Minister of Justice Abdelkaif Wabi,
12:33presented the main lines of this reform
12:38to focus on the main axes
12:41of this new Family Code.
12:47We are live with Mrs. Khaoula Ben Ammar,
12:50writer and activist of women's rights.
12:55Hello, Khaoula Ben Ammar, thank you for being with us.
13:00Hello, thank you.
13:03So, after the completion of the process
13:07of the various consultations supervised
13:10by the institution in charge of the revision of the Family Code,
13:14what are, in your opinion, the main axes of this reform?
13:22So, when we talk about this reform,
13:25the main axes are these new laws,
13:30this new Family Code on Inequality,
13:33on men and women,
13:35on the protection of children,
13:38the access to a family balance,
13:41but also on re-establishing norms on education,
13:49because when we talk about legal marriage from the age of 18,
13:58it means that we are protecting little girls and boys from leaving school.
14:05So, it is also a very important axis
14:09and which has been part of our plebiscite for a very long time,
14:13as activists and human rights activists.
14:18Another axis is communication,
14:24because laws that are not well explained,
14:28with little communication,
14:32make a society and citizens who do not understand what is happening
14:37and who cannot adopt or apply them.
14:40So, of course, when we come back to the communiqué of the Royal Cabinet,
14:47we also come back to the respect of the international agreements ratified by Morocco,
14:54to the change of laws in the application of a moderate Islam.
15:01This is very important.
15:03Morocco has always followed a moderate Islam, a central Islam.
15:07There is also the fact of returning to the language of these future laws,
15:14because we are not there yet.
15:15We have not yet seen what the laws look like.
15:17We just had a few signs of these laws.
15:20We had a few…
15:23Precisely, among the major advances of this reform
15:30is the recognition of domestic work of women
15:34as an economic contribution in its entirety,
15:37an unprecedented provision.
15:40What do you think?
15:42Listen, it's just justice.
15:45We can no longer move forward with families who decide to live in a certain way.
15:50It is a balance between all the components of the family,
15:54according to what we want to live.
15:56Because above all, a family is a man and a woman who meet,
16:00who want to build something,
16:02who want to build a family,
16:04who want to have children,
16:06who want to set up a certain way of life.
16:08So when we get along and we agree on this way of life,
16:12there is no reason for the person who stays at home
16:17because the other is working,
16:20to find himself in the risk that at some point
16:24is nothing at all,
16:26because it is also work to take care of the children.
16:29It's a lot of work and it's very important for society
16:32and for the country in general.
16:35There is no reason to neglect this
16:39and say to yourself, she's just at home, so she didn't do anything.
16:43Regarding the protection of children's rights,
16:47in his statement, the Minister of Justice,
16:50Abdi Tefoebi, emphasized that the new provisions
16:53aim to provide a more equitable and protective framework
16:57for minors,
17:00especially in situations of divorce of parents.
17:04We are talking about a redefinition of the principle of child protection.
17:12Listen, I want to tell you that the family code
17:16revolves around that.
17:18We are talking about the future generation
17:21and what we are experiencing in everyday life
17:24creates problems for future generations.
17:27So, protect children,
17:29put them back on the rails of education, of school,
17:32because basically a child has nothing to do
17:35in another system than in school,
17:38to achieve a certain autonomy of men and women of tomorrow,
17:42in an equitable, balanced, healthy society,
17:47free of violence,
17:49because all the imbalances create tensions in society
17:53and result in violence,
17:56precarious situations.
17:59A child needs both parents,
18:02whatever the situation,
18:04no more mother than father,
18:06no more father than mother,
18:08it's a balance,
18:10it's to reach a certain mental balance,
18:14to reach a future generation
18:17that does not grow up without the father because he had a divorce,
18:21because it's very important to come back to that too.
18:24We often come back to the economic aspect
18:27because that's where it hurts
18:30and that's what comes back very often in society,
18:34but we often forget certain points
18:37where children grow up with only one parent
18:41because we don't find a common ground.
18:44The current modwana makes parents,
18:47dads, not have the right to see their children enough.
18:50It's not normal.
18:52It's not about saying it's the mother who's in charge,
18:55she's responsible for the children,
18:57she's the one who educates,
18:59and the father only gives money.
19:01No, it's both, at all levels,
19:03on all axes.
19:05It's a common responsibility.
19:07We decide, men and women,
19:09that is, in a couple,
19:11we decide to have children.
19:13From that moment on,
19:15it's the responsibility of both parents,
19:17whether it's financial, in terms of education,
19:19in terms of guardianship,
19:21everything must be shared.
19:23In terms of guardianship,
19:25the guardianship of children,
19:27until now automatically attributed to the father,
19:30would now be shared
19:32between the two spouses,
19:34even after a divorce.
19:36According to the new bill,
19:38would the mother no longer risk
19:40losing custody of her children
19:42if she remarried?
19:44Yes, absolutely.
19:46This is another point
19:48that was mentioned in the future amendments.
19:50Let me remind you that
19:52we had a few points,
19:54we don't know all the details
19:56of the 139 amendments,
19:58and yes, the guardianship
20:00will be shared between the two parents,
20:02which is completely normal.
20:04We don't stop being parents
20:06from the moment
20:08we divorce.
20:10Having custody,
20:12having guardianship,
20:14it's the same thing
20:16that should go to the father
20:18so as not to have to deal
20:20with conflicts,
20:22tensions,
20:24pressure.
20:26A mother is a mother.
20:28When we have given birth
20:30to a child,
20:32we should be responsible
20:34for it up to its maturity.
20:36It's the same for the father.
20:38We can no longer find ourselves
20:40in situations where it is absolutely necessary
20:42for the father to sign the paper
20:44and that it is absolutely necessary
20:46that it is the mother
20:48who keeps the children.
20:50The shared guardianship,
20:52we find in the
20:54feminist movement
20:56that it is just a return
20:58to the norm.
21:00Now, of course, there are other points.
21:02We are still waiting to see
21:04what will happen
21:06to have more details.
21:08Of course,
21:10when we are discovering
21:12what will come,
21:14we say to ourselves,
21:16there are still small disappointments.
21:18There are things on which
21:20we still have a lot of questions.
21:22There are things on which
21:24we must continue to plead,
21:26which must continue to pass.
21:28Now, we are not there yet.
21:30There is also the writing of the texts
21:32that will happen.
21:34A code of the family.
21:36One last question,
21:38another key point
21:40of this reform project
21:42concerns the legal age of marriage
21:44which is maintained at 18 years.
21:46However, exceptions
21:48persist.
21:50Your comment?
21:52The only comment I want to make
21:54is why these exceptions,
21:56the truth.
21:58Do we really need
22:00to say that it will persist,
22:02that we will continue with certain exceptions?
22:04We have already seen the exercise
22:06of the exception.
22:08We hope that it will not become a norm.
22:10Why 17 years?
22:1218 years,
22:1818 years is good.
22:20It is the majority.
22:22At less than 18 years,
22:24we say to ourselves
22:26that the place of the children,
22:28we are still children,
22:30the place of the children is at school.
22:32It is the installation of a process
22:34to have full citizens
22:36with obligations, with rights,
22:38with a certain
22:40financial, mental economy
22:42and the capacity to have
22:44this generation that is totally independent.
22:46I am talking about boys and girls,
22:48both at the same level of equality.
22:54Thank you for answering
22:56our questions.
22:58Thank you for this enlightenment.
23:00I remind you that you are a director,
23:02activist for women's rights.
23:06It was a pleasure.
23:10This is how
23:12this edition ends.
23:14Thank you for following it.
23:16Stay with us.
23:18The training continues on EDF.
