An accountant from GISB Holdings Sdn Bhd (GISB) who was charged under the Security Offenses (Special Measures) Act 2012 (Sosma) for being a member of an organised crime group, became the first accused to be released on bail at the High Court in Shah Alam on Monday (Jan 13).
Judge Datuk Seri Latifah Mohd Tahar made this decision after allowing the application by lawyers Kamal Hisham Jaafar and Muhammad Nor Tamrin representing GISB accountant Hamimah Yakub, 73, as the applicant.

00:33While reading the brief decision, Latifa said,
00:36Section 13, subsection 2B of the SOSMA Act states that any accused shall not be granted
00:44bail except under several bail exemption categories.
00:48However, after reading the application notice and hearing written arguments from all parties
00:55and considering that the prosecution did not object to the application, the court used
01:00its discretionary power to allow bail.
01:03The court also took into account that there is no evidence from the prosecution that the
01:07applicant poses a risk of fleeing or interfering with witnesses.
01:12The court also considered the applicant's age and health problems.
01:16Hamima was granted bail of 40,000 ringgit with two sureties and ordered to report to
01:21the Kajang District Police Headquarters once every two weeks.
01:25She must also surrender her passport to the court, not interfere with witnesses, and attend
01:31all proceedings until the trial is completed.
