00:00As-salamu alaykum, you are watching Khabar Lahariya, I am Muhammad Malik.
00:16Today, our program has become very short because as you were seeing a while ago, President Trump's oath taking, he has taken oath as President in 1947.
00:27So what will be its implications for Pakistan, we will talk about that later.
00:31We have two guests, Sheikh Waqas Akram Sahib and Barrister Aqeel.
00:35We have to apologize to Sheikh Waqas Akram Sahib because the time for the segment is over.
00:41But Barrister Aqeel is joining us now, we will talk to him.
00:45In a way, it has become interesting because when we talked about the law and the 26th Amendment was passed,
00:54and the entire form of the Supreme Court was changed, and Justice Mansoor Ali Shah was not allowed to become Chief Justice,
01:02then the Ayni Bench was formed, on which we thought that the court will be formed within the court and there will be disputes.
01:08But the government kept telling us again and again that the old time is over.
01:12The differences between the judges, the groupings of Faizeesa Sahib and Umar bin Dayal Sahib are now things of the past.
01:20And as Yahya Afridi said a few days ago, he said that now we are one, and the old groupings are over.
01:30But after what happened in the Supreme Court today, it seems that it has become more intense than before.
01:37Earlier, there was not a divided court in the court, only the judges were divided, but now the court is also divided.
01:44The Ayni court of the Supreme Court is separate, the benches of the other court are separate.
01:48Today I want to read you the baton that was reported, which was exchanged today.
01:54The scene was that there was a tax-related matter on which a bench of the Supreme Court was listening,
02:02and on 16th, they said that a case should be filed in front of us on 20th.
02:07Today, when it happened on 20th, the case was not filed in front of them.
02:11On that, they called the Deputy Registrar.
02:13They said, how is it possible that our orders should not be filed in front of the General?
02:16So, the Deputy Registrar said that because there was a legal matter, there was an interpretation,
02:21so our research officer said that this case should not be filed there.
02:26So, the judges were shocked.
02:28They said that a research officer will tell us what will happen.
02:31But just by listening to a few sentences, you will get an idea of what this temperament was.
02:36Justice Mansoor Ali Shah said that call the Additional Registrar immediately,
02:44if you get to know, then what will not happen?
02:46And they asked for the details of the Judges Committee as to what happened that day.
02:50But they come to the point later that why did the cause list change?
02:52The Deputy Registrar came to the court.
02:54He said that the condition of the Additional Registrar is not good, he is on leave.
02:58Why did the court not give the order to file the case, Justice Mansoor Ali Shah?
03:02The Judges Committee has decided that the case of Tarmeem will be filed on 27th January by the Deputy Registrar.
03:09I am also a member of the committee.
03:11I have no idea, Justice Mansoor Ali Shah.
03:13How can the Administrative Committee ignore the judicial order?
03:18Now, Justice Ayesha Malik will also be included in this.
03:20Now, the third judge will also speak.
03:22Was the court order placed in front of the committee, Justice Saqeel Abbasi asked?
03:28The judicial order was presented to the committee, Deputy Registrar Zulfiqar Ahmed.
03:32Justice Ayesha Malik, why was the cause list of our entire week changed?
03:37And on this, they said, get the record and Justice Mansoor has been on leave for a while.
03:43On this, the Deputy Registrar tells the court again that the Judges Committee did not receive any written order.
03:49If the committee did not receive the order, then why was the case not decided, Justice Mansoor Ali Shah?
03:54How can the appointed case, i.e. bench, be transferred, Justice Ayesha Malik?
03:59No one has the right to transfer the case, including the Chief Justice, Justice Saqeel Abbasi.
04:04Now, remember that now this or Mr. Fareedi is also coming under fire.
04:08When Sindh High Court was there, such an attempt was made with us, Justice Saqeel Abbasi.
04:13Chief Justice Sindh High Court was forced to file a case in front of us.
04:18Why have other cases been delisted, Justice Ayesha Malik?
04:22All the cases were decided under the judicial order.
04:25Now the Deputy Registrar said, the Research Officer has a note,
04:30on legal questions, the appointed case will be heard by the appointed bench.
04:33Will the Research Officer now review the judicial orders, whether it was right or not, Justice Ayesha Malik?
04:39And in my judicial career, it did not happen that the case disappeared.
04:43Now, it has started, including Chief Justice Saqeel Abbasi, all people are bound by the judicial order.
04:50Deputy Registrar, the meeting minutes of the Judges Committee have not yet been received by the Deputy Registrar's Judiciary.
04:55This case has gone to the Administrative Committee, Justice Mazoor Nisha.
04:59If Justice Irfan Saadat is busy, then someone else should come to the bench.
05:03The committee has no such authority that it does not file a case.
05:07Then there was a lot of heat on this, and then they issued a contempt of court notice to the Deputy Registrar and called him tomorrow.
05:16Now, everyone thought that when these changes happened,
05:20that either Mr. Fareedi is a neutral judge to some extent, then he will handle it.
05:25But then we saw that Justice Muneeb Akhtar did not come to any bench.
05:31And now the committee has only brought in Mr. Mansoor Ali Shah.
05:35But from the first day, it seems that the same work has started.
05:38Mr. Mansoor Ali Shah has also written a letter to us.
05:42If this court is still as split, and now there is a split in the same court in the biggest of the Judiciary Benches,
05:48and that same Judiciary Bench will now perhaps decide the future of this huge case of political history.
05:56There was a trial of Mr. Bhutto, he changed the date of this court,
06:00and now the decision as to whether Imran Khan's case will go to the military court or not,
06:05is now with this bench.
06:08Will this split Supreme Court be able to give non-controversial justice?
06:13We will talk about this as well.
06:15And at the same time, we are hearing so many things,
06:18that this envelope was waved and everything happened.
06:22Can the government open this envelope?
06:25And if the government has given a sovereign undertaking to the National Crime Agency UK,
06:32then why don't they write to them that there is such a big crisis here,
06:35there are political ramifications, there is a legal fallout.
06:38So if we open this envelope,
06:41Imran Khan has also repeatedly said to open the envelope,
06:44Malik Riaz's family has also said that if there is, then open it,
06:48you will find out what is in the deal.
06:50Everyone is saying to open the envelope.
06:52And that party that says that all the crime, all the corruption is present in this closed envelope,
06:58not only are they not interested in opening the envelope,
07:00they will also ask the lawyer, why don't you open the envelope?
07:04And they will also ask that if the judges are so split,
07:08then our fate is left with split decisions and controversy.
07:12Especially in big criminal cases as well.
07:15You guys are smiling a lot these days, you have got a lot of punishments.
07:18You guys are jumping around like you don't know what, you have won everything.
07:22Bismillahir Rahmanir Rahim.
07:23Malik Sahib, thank you very much.
07:24No, we are smiling from the beginning.
07:26And we have been smiling since 8th February.
07:28It might be a short-lived smile,
07:30but the previous cases that go to the High Courts and they are not released.
07:36First of all, the appeal should be filed on their number.
07:38The entire purpose of the 26th Annual Reformation was that
07:41the cases of people that have been waiting for so long,
07:45that don't take up 20-20 years,
07:46should at least be extreme and should come in a process.
07:49So it should be Imran Khan's turn, this process should be done.
07:51No, everyone's, not just Imran Khan.
07:53Everyone's should be filed on their time.
07:55The old cases that are pending, the ones that are pending since 2012,
07:58they should be filed earlier, instead of filing them before 2025.
08:01Okay, tell us, first, I mean, the drama that has been going on in the Supreme Court today,
08:05we will talk about that as well.
08:06You told us, look at how we have made Chief Justices.
08:09Now the divide will end.
08:11Now all the judges, one will be Ganga Bairi.
08:14Today, swords have been drawn in the Supreme Court.
08:16And I read out the entire discourse at the beginning of the program.
08:20It has come to the point that Justice Ayesha Malik,
08:23who is technically a relatively junior judge,
08:26she was elevated a while ago.
08:28She also said, what is this Chief Justice?
08:30This is more than three people, a single Chief Justice.
08:33So this is the kind of thing.
08:34I will come to this later.
08:36The real problem is with Qadirwala, Khatwala, Jeevo, Lafafa, Leraya, everything.
08:41Why don't you guys open it up?
08:43Let us know what is in it.
08:45Whatever is in it, whether it is a bottle,
08:47you have it, the government has it.
08:49Look, I am sure it will be in the archives of the government.
08:52And when the previous government went,
08:54there was a closed envelope, a confidentiality agreement.
08:57Now, if we are being asked to make it public,
09:01then I am sure that the way they took the cipher and the copy,
09:04it is obvious that Shahzad Akbar and Imran Khan must have kept one copy with them.
09:08They could have presented it in their defense.
09:10What is their problem?
09:12No, no, let us assume that they do not have it.
09:15And it should not be there.
09:16In principle, it should not be there.
09:17The cipher should not be there either.
09:18Yes, yes, that is fine.
09:19You put a lot of pressure on the cipher.
09:21I am talking here.
09:23You are saying that the whole Jinn is in that envelope
09:26and all the corruption is based on it.
09:28And I don't know if they mislead the cabinet.
09:30They mislead it.
09:31You simply, the National Crime Agency, NCA of the UK,
09:35you write a letter to it, as a government,
09:37that this is a very big crisis in our country,
09:40it is political, it is destabilizing the whole system.
09:44We want to make it public.
09:46Do you have any objection?
09:47If there is, we will tell you.
09:49You have made a bigger issue by knowing it.
09:52No, you are right.
09:54For the sake of argument,
09:55And even Ibrahim Khan has said it.
09:56He said, open the envelope.
09:57It is a very good thing, for the sake of argument.
09:59So, first of all, there was no need to take a closed envelope to the cabinet.
10:03Because to bring this country and this whole thing in this context,
10:07Mr. Imran Khan and all the people of the cabinet,
10:09No, you don't talk about the cabinet.
10:11Writing to the NCA,
10:12Mr. Tarar gave a logic like this.
10:14He said, we did not take action against those members of the cabinet
10:18that they did not take any direct benefit from this deal.
10:20Those who voted for this.
10:22No, it is not true.
10:23When you are in the government,
10:27you took the MNA vote,
10:29there were certain provisions for it.
10:30When you are a minister and you are sitting in the cabinet,
10:33it is your duty to do what you have been allowed by the law.
10:37If you think you have done wrong legally,
10:40and you also say that these people have done wrong,
10:43then those people have betrayed their rights.
10:46They have approved it illegally,
10:49knowingly or unknowingly that it is illegal.
10:52So, you should have taken action against them anyway.
10:55Actually, the problem is that those who had approved it,
10:57they all have been appointed.
10:59The ministers appointed in your favor.
11:01Look, there is the testimony of Mr. Subedar Jalal.
11:05Mr. Fawad Chaudhary also left.
11:07Mr. Shiri Mazari also left politics.
11:09Take the name.
11:10Faisal Wada went to the other side.
11:12Faisal Wada also raised an objection.
11:14No, no, no, listen, listen.
11:15He is loyal. He is not with the PTI.
11:18So, you did not leave the cabinet members
11:21because they did not take direct advantage.
11:22But Fawad Chaudhary also left.
11:23Yes, Fawad Chaudhary has been appointed.
11:25Fawad Chaudhary has left the PTI.
11:27He left, but nowadays he is back.
11:29First of all, let's talk about those circumstances.
11:31You did not touch those cabinet members
11:34because they had left Imran Khan or were released.
11:38So, don't tell us that they did not take advantage.
11:40They raised an objection.
11:41They broke the law and you rewarded them.
11:44Not at all, not at all.
11:45Look, Mr. Malik, I can say this.
11:48The people who raised an objection,
11:49if they were Mullahs in May 9,
11:52they apologized and then left politics.
11:55So, what does this have to do with it?
11:57The people who were there as witnesses,
11:59and I will tell you the most important thing,
12:01Imran Khan and all his party deputies
12:03say that if there was any such evidence,
12:07it would have come forward.
12:07So, all these ministers,
12:09if they had not done anything wrong,
12:10as defence witnesses, they would have presented this.
12:12Prime Minister, let me tell you something.
12:15What you know is illegal.
12:16You have no say in it and the Prime Minister has.
12:19Let's make an example of Imran Khan.
12:21You said that Imran Khan took advantage,
12:23but those people did not.
12:25I will bring this case to you.
12:27You know that what the Prime Minister is telling me
12:29is legally wrong.
12:31And maybe they are taking advantage of it or not.
12:34And you just want to please them
12:35because you do that work for approval.
12:39Let's vote as a cabinet member.
12:42Should there be an action against you or not?
12:45Yes or no?
12:46Then why wasn't there an action against those people?
