00:26Dars-e-Bukhari, Kitab-ul-Hiba, Tof-e-Waqara, Bab-u-Kaifa, Yuqbad-ul-Abdu-Wal-Mata'u, Ghulam-ur-Samaan-Par-Kis-Tara-Qafza-Huta-Hai
00:48Hadith number is 2599, Hazrat-e-Miswar-bin-Makhramah, Radhi Allah-o-Ta'ala Anhu, narrates that the Prophet, peace and blessings be upon him, distributed some Qubas,
01:02Qubas are the clothes that are worn on top of the head, the government distributed these Qubas, and Hazrat-e-Makhramah was not given any of these Qubas,
01:16so Hazrat-e-Makhramah said, O my son, go to the Prophet, peace and blessings be upon him, so I went with him, so my father said, go inside and give the message to the Prophet, peace and blessings be upon him, that I have come,
01:32so I called him, the Prophet, peace and blessings be upon him, came, and he was wearing a scarf, he said that we had hidden these Qubas for you, my father looked at him and said,
01:48Hazrat-e-Makhramah was pleased, so he thought that the Prophet had distributed everything and he did not get it, so he went there, so if someone thinks that he did not get his right, then instead of remaining silent,
02:06or asking for your right, there is no harm in it, you can do it, like sometimes you are distributing something big at home, like Eid, all the children were present, you had gone out, it was distributed among everyone,
02:20then you came to know that Eid was distributed, so you can ask for it, even though we will not say that giving Eid is not obligatory, but since everyone got it, if you ask for it, then it will not be a question that you asked for it,
02:35you can do it, so Hazrat-e-Makhramah felt that he did not get the Quba, but everyone else got it, so he went and asked for it, if it was wrong, then the mercy of the two worlds would have prevented him from doing it,
02:50so it is obligatory to warn the Prophet, to warn of mistakes, to prevent from doing bad things, secondly, it is very temporary for the Prophet, that if someone comes, then the son calls the master, and the master comes out,
03:05you can also call them inside, but coming out yourself is a big thing, and every person should learn from this, Allah made his beloved in such a way that till Qiyamah, every person in the world is forced to make the Prophet a role model, and the Prophet is superior to him in that field,
03:33so when the mercy of the two worlds takes over something, then the one below should take it to that extent, for example, if you look at the ruler of the government, then the biggest government was of the Prophet, if you look at the love of Allah, then it is you, if you look at the great worshippers, then it is the government,

06:51So, in this way, by going to arrogant people,

06:57the insults and insults of the scholars are coming out,
07:00it should never be done.
07:02No matter how big the personal loss is,
07:04it should never be done.
07:07So, the mercy of the two nations came out,
07:10this is a big thing,
07:12and the Prophet said,
07:15We had saved the Qubah for you,
07:17the government had given it to you,
07:19that we had kept it for you.
07:21This means that,
07:22they did not have any misunderstanding,
07:24but always remember,
07:26from this point of view,
07:28whoever is associated with a great person,
07:30by great I mean a religious scholar,
07:33a scholar, a mufti, a sheikh,
07:36a Pir, a great Mu'amal Pir,
07:38from them, in such matters,
07:41you should maintain good thoughts.
07:43Because of these small things,
07:45because of worldly things,
07:46never be offended by your elders,
07:48that you cut off the chain of creed.
07:51And the gift that was given to everyone,
07:52was not given to me,
07:53now I will not go.
07:54That is, you had gone for the gift,
07:56that according to you,
07:57the worldly things are better than the blessings you get from them.
08:01So, it is better not to go to such a person,
08:03who unnecessarily puts misunderstandings in the hearts of others,
08:06misunderstandings,
08:07misunderstandings in the heart,
08:08misunderstandings,
08:09ruined his hereafter,
08:11then it is better to stay away.
08:13So, there are such people everywhere,
08:16who do not remain silent.
08:18And I am sorry to say,
08:20that our sisters are far ahead in this.
08:23They attack immediately.
08:25Some have not even learned to remain silent.
08:27They immediately express misunderstandings.
08:30And then sometimes they are ashamed later.
08:32This should not be done.
08:34Be careful about this.
08:35And the men are also not less.
08:36Anyway,
08:37the sisters will say,
08:38Mufti Sahab said to the women,
08:39the men are also not less.
08:40But among the women,
08:41we have seen this more,
08:42that they have less tolerance.
08:44Whatever comes to mind,
08:45sometimes misunderstandings immediately occur.
08:47They arrange a result themselves.
08:49And they are not inclined to keep the arranged result in their mind or heart.
08:55They immediately express it in front of someone.
08:58And then they are ashamed later.
09:00So, this should not be done at all.
09:02We come to the next hadith.
09:05It is hadith number 2600.
09:08And the chapter has been established.
09:16When something was given to someone as a gift,
09:20and he took possession of it,
09:22and did not say with his tongue that I have accepted it.
09:25Remember one thing well.
09:27If you give a gift to someone,
09:29if the other person does not accept it,
09:31then this gift will come out of your possession,
09:34and will not enter his possession.
09:36For example, you go to someone and say,
09:38I have brought a gift for you.
09:40He saw and did like this.
09:42You kept it close and came.
09:44So, this will not go into his possession.
09:46This is yours.
09:47Remember.
09:48Yes, if he said,
09:49I accepted it.
09:50This has to be accepted verbally.
09:52Or he did not say anything with his mouth.
09:54Okay, thank you.
09:55He said this and kept it.
09:56This has to be accepted practically.
09:58Until the other person accepts,
10:01the gift will not go into his possession.
10:04And if it does not go into possession,
10:06it will remain with you.
10:07Now, sometimes there are many issues of inheritance.
10:10For example,
10:11the mother said to someone,
10:12this gold set is yours.
10:13She said this to a daughter.
10:14But the daughter did not accept it.
10:16And the mother passed away.
10:18So, this is not the daughter's.
10:19She cannot say later that this is mine.
10:21My mother gave it to me.
10:22So, you did not accept it.
10:23When you did not accept it,
10:24it remained in the possession of the mother.
10:26And when it remained in the possession of the mother,
10:28then it is an inheritance.
10:29All heirs have a right to it.
10:31So, remember this well.
10:33There is a word,
10:35Hiba Taam Ho Jaana.
10:37Hiba Taam means to complete the gift.
10:41It means to be complete.
10:44And what does it mean to be complete?
10:46That the thing goes out of your possession
10:48and enters the possession of another person.
10:51Now, you are no longer the owner.
10:53The other person becomes the owner.
10:54And when is Hiba Taam?
10:56Hiba Taam means that
10:57when you give someone a possession
10:59and give him the right to complete it.
11:03Do whatever you want with it.
11:05Break it.
11:06Give it to someone else as a gift.
11:08Sell it.
11:09If you give the house as a gift,
11:10then rent it.
11:12When you give such rights,
11:14then Hiba Taam happens.
11:16And the thing goes out of your possession
11:18and enters its possession.
11:21But if you do not do Hiba like this,
11:23then Hiba Taam will not happen.
11:25The thing will remain in your possession.
11:27So, don't feel bad.
11:28Many people will get worried.
11:30But sometimes,
11:31the husband makes a house in the name of his wife.
11:34And also prepares the documents.
11:36But the wife does not have the right
11:38to rent the house,
11:39give the gift to someone else,
11:41sell the house.
11:42These are not the rights.
11:44So, just remember that
11:45by preparing the documents,
11:47the thing will not go out of the possession of one person
11:49and enter the possession of another person.
11:51Although legally,
11:52the law will say that
11:53the person whose name is in the documents,
11:55has become the owner.
11:56But are you asking about the law
11:58or the Shariah?
11:59If you want to know about the Shariah,
12:01then the Shariah command will be that
12:03this house is not of the wife.
12:05It is of the husband.
12:06So, if the husband dies now,
12:08then it is the inheritance.
12:09In this, the heirs will get a share.
12:11It will not be of just the wife.
12:13So, if someone wants to do this,
12:15that for example,
12:16he wants to distribute in his life
12:18among sons and daughters,
12:19someone has a house,
12:20someone has a shop,
12:21someone has a plot,
12:22someone has gold,
12:23someone has jewelry,
12:24and in the same way,
12:25he wants to do something in the name of his wife.
12:27So, after doing this,
12:28by preparing the documents,
12:29you will have to give full authority.
12:31Total.
12:32Give possession
12:33and say that now it is yours.
12:35Do whatever you want.
12:37And suppose,
12:38if they sell that thing in front of you,
12:40then you cannot stop.
12:41Do not stop.
12:42Okay.
12:43So, this means that
12:44you have actually
12:45given them this thing
12:47and it has become complete.
12:49It has become complete.
12:50So, this will enter their possession.
12:52Therefore,
12:53all those people who are listening to me,
12:55who have said that
12:56if I die,
12:57this house belongs to my son,
12:58this shop belongs to my daughter,
13:00and this will be with my wife,
13:02and I have died.
13:03After your death,
13:05you have no right to any of your wealth.
13:07Then you are not there.
13:08Then there is Shariah.
13:09Shariah will do.
13:10Therefore,
13:11as soon as you die,
13:12in everything,
13:13all the heirs have a right.
13:15Yes, if they are satisfied,
13:16this is called reconciliation.
13:18They do as they were told.
13:20This can also be right.
13:21But if they object,
13:23that we do not believe this.
13:25This has been said in life.
13:26Heritage is made after death.
13:28So, they are doing absolutely right.
13:30And there is no sin in this.
13:32There is no immorality in this.
13:33Nor will they say that
13:34if you do not believe your father,
13:36you will go to hell.
13:37Absolutely wrong.
13:38That heir has a right.
13:39Everything has a right.
13:40Therefore,
13:41if everyone wants,
13:42then he will get it done
13:43exactly as it is in Shariah.
13:45But remember that
13:46if there was no action in life,
13:48then anyway,
13:49things do not enter the family.
13:52So, now see,
13:53Hadith number 2600 is pure.
13:55Hazrat Abu Huraira,
13:57may Allah be pleased with him,
13:58is the narrator of this.
13:59He says that
14:00a person came to the Prophet
14:02and said,
14:04O Messenger of Allah,
14:05I have perished.
14:06The Prophet said,
14:07what is the reason for this?
14:08Why are you saying this?
14:09He said that
14:10in the month of Ramadan,
14:12I established a physical relationship
14:14with the Prophet.
14:16That is,
14:17in the month of Ramadan,
14:18in the state of fasting,
14:19within the day.
14:21The Prophet asked him,
14:22do you have any slaves?
14:24Because now
14:25he had to give Kaffarah.
14:26So the government started asking
14:27about Kaffarah in order.
14:29Do you have any slaves?
14:31He said no.
14:32The Prophet said,
14:33can you fast for two months in a row?
14:36He said no.
14:38The Prophet asked,
14:39can you feed sixty poor people?
14:42He said no.
14:44Then,
14:45one of the Ansar
14:46brought a basket
14:48made of date leaves
14:50in which there were dates.
14:52The Prophet said to that person,
14:54come here,
14:55pick up this basket,
14:57take it
14:58and give it as charity.
15:00Then you will have Kaffarah in it.
15:02He said,
15:03O Messenger of Allah,
15:04is there anyone more in need than me?
15:10Meaning,
15:11should I give charity to him?
15:12Is there anyone more in need than me?
15:14Meaning,
15:15there is no one.
15:16I am the most in need.
15:18By that person
15:19who has given you the right,
15:21between the two sides of Madinah,
15:23there is no house more in need than us.
15:27The Prophet said,
15:29go,
15:30give a basket to your family.
15:32In this,
15:33your Kaffarah will be fulfilled.
15:35So now see,
15:36this actually happened that
15:38Hiba,
15:39did not say,
15:40I have accepted it.
15:41The government said,
15:42go,
15:43give it to them.
15:44So Hiba was fulfilled.
15:46Now see,
15:47there are a few things in this.
15:48The main thing was this,
15:49and the secondary thing is this,
15:51that in Ramadan,
15:52maintaining a physical relationship,
15:54when the spouses are in the state of fasting,
15:57this breaks the fast.
15:59And if you do it on purpose,
16:00by doing it on purpose,
16:01it means that
16:02you remember that you are fasting,
16:03and then this happens,
16:04then Kaffarah is obligatory on this.
16:06And there is no form of forgiveness in this.
16:08In this,
16:09first of all,
16:10the slave will have to be set free.
16:11The order is obligatory in this.
16:12And the slave,
16:13nowadays there is no time,
16:14so 60 fasts will have to be kept in a row.
16:17In this,
16:18for a man,
16:19the commandment is that
16:20if even one day goes wrong,
16:22that is,
16:23he had kept 69,
16:24and started keeping 60,
16:26that he fell ill,
16:27then all the fasts will be canceled tomorrow.
16:29He will have to keep it again.
16:30It has to be kept in a row.
16:31Absolutely in a row.
16:32Such women also have to be kept in a row.
16:35But,
16:36days of fasting are exempt from this.
16:38That is,
16:39suppose you had kept 10 fasts,
16:40then the days came,
16:41then it will continue beyond 10.
16:43After fasting,
16:44it will be 11th.
16:45Okay?
16:46But,
16:47for a man,
16:48there is no such exemption.
16:49For him,
16:50it is a very strict commandment
16:51that if he has kept 69,
16:52and left one due to illness,
16:53he will keep it again.
16:54Because,
16:55there is a restriction on it.
16:56In this,
16:57there will be no exemption.
16:58Okay,
16:59some people say,
17:00we cannot keep fasts,
17:01we keep,
17:02we give this Fidya.
17:03This will not happen.
17:04If they can keep fasts,
17:05whether in summer,
17:06or in winter,
17:07when the days become very short,
17:09they will have to keep fasts.
17:11If they do not keep,
17:12when they can keep,
17:13and give food,
17:14that is,
17:15they give Kaffara,
17:16after giving food,
17:17it will not be paid.
17:18And,
17:19in the field of society,
17:20both will be caught.
17:21Therefore,
17:22when this action has been done,
17:23then the punishment for it
17:24should also be borne in the world.
17:25It is a very good thing.
17:26According to us,
17:27the punishment of the hereafter
17:28has become lighter
17:29than the punishment of the world.
17:31Therefore,
17:32here it is said,
17:3360 fasts,
17:34I am not keeping.
17:35And,
17:36did not think that
17:37the humiliation in the field of society,
17:38which will be a disgrace,
17:39if Allah gets angry
17:40and puts it in hell,
17:41then,
17:42how will they tolerate it?
17:43Here hunger is not tolerated.
17:44So,
17:45why did you do it?
17:46Then,
17:47you should have stayed away.
17:48You should have fulfilled the requirements of the Shariah.
17:49When you broke the Shariah,
17:50broke the Shariah,
17:51broke the commandment of Allah,
17:52then,
17:53present yourself
17:54even on punishment.
17:55We are not ready
17:56to forgive anyone.
17:57If someone
17:58takes our mobile
17:59at our gunpoint,
18:00if he is caught,
18:01we say,
18:02hit him by catching him.
18:03And,
18:04we are asked,
18:05do you forgive?
18:06Or,
18:07put him in jail.
18:08We say,
18:09put him in jail
18:10so that he gets advice.
18:11But,
18:12for us,
18:13we say,
18:14we should be forgiven.
18:15Allah,
18:16change the Shariah punishments
18:17for us.
18:18Why?
18:19Are we such great
18:20saints of Allah?
18:21Or,
18:22are we doing a great deed
18:23that the punishment
18:24should be changed for us?
18:25It will be necessary
18:26to present on punishment.
18:27We will talk about this
