00:00Different scenarios can result in an impeachment trial
00:05depending on whether the accused is guilty or resigned.
00:11Others have witnessed it in history.
00:14Let's find out the possibilities in the trial of Mav Gonzales.
00:21The Senate is now preparing for the impeachment trial of Vice President Sara Duterte,
00:26the third case to be investigated in the history of the Philippines.
00:30Rules of impeachment are being studied
00:33and a robe will be made for the senators to be judged.
00:36In the Senate Museum, the former impeachment robes
00:40of the former senator and now President Bongbong Marcos are on display.
00:44This is what they should have worn during the impeachment trial of former Chief Justice Renato Corona.
00:49This is what President Bongbong Marcos should have worn as a senator.
00:54But they changed the fabric, they made it velvet, so they didn't use it anymore.
01:00But there are different versions here.
01:02Senate President Chisa Escudero said that they will use this color
01:06because this is the official color of the Senate.
01:08There is also an impeachment vault
01:10where the envelopes of evidence of the impeachment of former President Estrada were placed.
01:16The witness stand of the Corona impeachment, which is also displayed here,
01:20was taken to be used again in the impeachment of VP Sara.
01:24In an impeachment trial, the senator judges will be judged
01:27on whether the defendant is guilty or not guilty.
01:30If the defendant is guilty, he will be removed from his position
01:33and will no longer be able to hold any position in the government.
01:36Like the case of former Chief Justice Renato Corona in 2012,
01:41who was found guilty because he did not declare his wealth
01:44in his Statement of Assets, Liabilities, and Net Worth or SALIN.
01:48If he is acquitted, he will be able to file an impeachment complaint after a year.
01:54In the history of the Philippines, no official has been acquitted.
01:59The impeachment trial may also not continue
02:02because the official resigned from his position.
02:04Like the case of former Ombudsman Maria Merceditas Gutierrez,
02:08who was impeached for not taking immediate action
02:11in the cases of former President Gloria Arroyo and others.
02:14In 2011, before the trial began,
02:17she resigned from her position and the Senate just archived the impeachment complaint against her.
02:22In the case of former Comelec Chairman Andres Bautista in 2017,
02:28a few hours after he announced that he would resign at the end of the year,
02:32he was impeached by the camera
02:33because he did not declare his wealth and other assets.
02:37President Rodrigo Duterte immediately accepted his resignation.
02:41But the Constitutional Law expert, Atty. Domingo Cayoza,
02:45believes that the impeachment trial should continue even if the official resigned.
02:50Not only was the penalty removed from his position,
02:52but there was also a disqualification for holding a position in the government.
02:56People have to know whether or not the charges are correct.
03:01The Constitution does not say or.
03:03It says and disqualification from any public office.
03:07I don't think it's good, public policy also,
03:12to just let people resign and then they will not be held accountable.
03:15Even if the impeachment trial begins, it can still go ahead,
03:20like the case of former President Joseph Estrada in 2001
03:24because he had an EDSA dos before he was elected.
03:27Cayoza said that this is a violation of justice.
03:31Admittedly, an impeachment trial or impeachment is a political process,
03:38but it is not totally political.
03:42So equally important, even more important than the political,
03:48you know, persuasions of the actors in the impeachment trial,
03:54is the truth, is the truth and accountability.
03:57And you can only determine that in an orderly manner
04:00if you finish an impeachment trial.
04:03The Supreme Court can now decide to remove an official from his position,
04:08like former Chief Justice Maria Lourdes Sereno.
04:11In 2018, the impeachment complaint against him was approved by the House Committee on Justice
04:17for not filing his case when he was still teaching at UP.
04:21But he was dismissed by his fellow magistrate in the Supreme Court
04:25who filed a co-oranto petition against him.
04:28Whatever the scenario,
04:31Cayoza said that criminal and civil cases can still be filed against the impeached official.
04:37If there's enough evidence,
04:39they can pursue criminal charges against the impeached official.
04:43There's no double jeopardy.
04:44As a matter of fact, even civil charges for cases for civil damages may arise out of the same file.
04:53For GMA Integrated News,
04:55Mav Gonzalez, Nakatutok, 24 Horas.
