00:00The Perlis state authorities were not allowed to challenge a decision which quashed the
00:06conversion of Low Siu Hung's three minor children to Islam, as the proposed appeal
00:11was bound to fail, according to the federal court.
00:15Justice Nalini Padmanathan said there was no prima facie case of success in the appeal
00:20and dismissed the application for leave to appeal.
00:23The Perlis Islamic Religious and Malay Customs Council, the Registrar of Converts, State
00:28Mufti Azri Zainul Abidin, and the state government had filed the motion.
00:33Nalini emphasized that the Indira Gandhi case established that both parents must consent
00:37to a minor's religious conversion, making unilateral conversions unconstitutional.
00:43The court reaffirmed that Indira Gandhi's ruling applies nationwide, not just in federal
00:47territories, and that civil courts can review public authority decisions that conflict with
00:52the federal constitution.
00:54Low, who married M. Nagaswaran in 2008, was separated from her children due to domestic
00:59abuse and later obtained sole custody in 2020, but Nagaswaran had already converted to Islam
01:05and attempted to convert their children.
01:08Though Low initially failed to overturn their conversion in the High Court, the Court of
01:11Appeal ruled in her favor, ensuring that her children remain Hindus.
