00:00The appeals chamber concluded that the pretrial chamber committed an error of law by failing to sufficiently address Israel's argument that it was entitled to make a jurisdictional challenge.
00:10After months of high stakes legal drama, arrest warrants and global headlines, the International Criminal Court's appeals chamber has sent the Gaza war crimes case involving Israeli leaders back to square one.
00:23Turns out the judges didn't properly address a rather basic question. Does the court even have jurisdiction?
00:30And now the ICC must pause, go back and actually engage with Israel's core argument that the court has no legal right to investigate a country that's not a party to the Rome Statute,
00:41especially when it concerns a territory like Gaza, whose statehood is still politically and legally contested.
00:47The warrants targeting Israel's prime minister and former defense minister were requested in May 2024 and formally issued last November.
00:55They accused Netanyahu and Galland of crimes against humanity during the Gaza war.
01:01And those warrants are still technically active, but this ruling throws a legal wrench into their enforcement.
01:07For Palestinian authorities and victims groups, of course, this is a frustrating delay in a case they hoped would finally bring accountability.
01:15For Israel, it's a win in a courtroom that often feels hostile.
01:20We said it from the start. The International Criminal Court in The Hague doesn't have and never had jurisdiction to issue arrest warrants against Israel's prime minister and its former minister of defense.
01:33It is clear to everyone that The Hague Tribunal is being run as a political tool that serves Israel's enemies.
01:38The decision to reconsider the question of jurisdiction exposes the lack of legitimacy behind the political arrest warrants.
01:47Israel will continue to defend itself in coordination with its partners and will not remain silent in the face of such hypocrisy.
01:54For the ICC, this moment is more than just legal procedure.
01:58It's a test of credibility and a growing number of countries are already losing faith.
02:03Take Hungary. An ICC member not only welcomed Netanyahu in Budapest, but then announced it was withdrawing from the court altogether.
02:12Or Germany said it would comply with the ICC's decision, but quietly ensure there was no situation where they'd actually have to act.
02:20Netanyahu never came. Problem solved.
02:22The UK kept a diplomatic straight face, but just carried on with business as usual.
02:28And Kenya, another ICC member, went even further, publicly condemned the court and reaffirmed its support for Israel.
02:35And then there is the United States, not a member of the ICC, but never far from its reach.
02:41When the court moved to investigate American forces in Afghanistan, you remember Washington slapped sanctions on the ICC's top prosecutor.
02:48And this year, with the court targeting Israel, U.S.'s key ally in the Middle East, American administration did just the same.
02:56Why is the U.S. so nervous?
02:58Because if the ICC pushes forward here, it could set a dangerous precedent for investigating non-member states, something many powerful countries, including the U.S., actually fear.
03:09This latest ruling feels like a punchline, especially for those who hope that the ICC could finally bring accountability for what's happening in Gaza,
03:19where more than 50,000 Palestinians have been killed in months of war, including thousands of children.
03:25The next phase, a reexamination of jurisdiction, won't just shape this particular case.
03:30It could redefine how far the ICC is willing or allowed to go when dominant global powers are enrolled.
03:38And the world will be watching.
