00:00 Alex Murdaugh's lawyers say South Carolina's Attorney General's office is acting in bad
00:04 faith in latest new trial bid.
00:06 The lawyers accused the state of inventing preposterous procedural hoops.
00:10 The lawyers representing Alex Murdaugh, the South Carolina former lawyer convicted in
00:14 March of murdering his wife and adult son in 2021, filed a new motion Thursday accusing
00:19 the state of responding in bad faith to its request for a new trial over allegations of
00:24 jury tampering directed at a county clerk.
00:26 The state unfortunately has chosen to respond in bad faith to these serious allegations,
00:31 attorneys Dick Harputlian and Jim Griffin wrote in the motion.
00:35 Earlier this month, Harputlian and Griffin filed a motion accusing Rebecca Hill, a Colleton
00:40 County clerk, of betraying her oath of office for money and fame by rushing the jury to
00:44 reach a quick verdict and telling jurors not to believe Murdaugh's testimony or defense
00:49 evidence.
00:50 Murdaugh's attorneys allege that Hill misrepresented critical and material information to the judge
00:54 in order to remove a juror she thought was favorable to the defense.
00:58 Now, the legal team is accusing the state of wanting Murdaugh to spend weeks jumping
01:02 through preposterous procedural hoops invented only for him, according to court documents.
01:07 South Carolina State Attorney General Alan Wilson initially responded to the request
01:11 for a new trial by calling the submission "procedurally defective," citing inconsistencies
01:16 in press briefings and interviews from Murdaugh's attorneys and lack of affidavit from Murdaugh,
01:20 among other issues, and asked the court to allow 10 days for a corrected motion.
01:25 This latest filing by Harputlian and Griffin argued that the state invented a "preposterous
01:29 procedural requirement," but demanding an affidavit from Murdaugh stating he was "unaware
01:34 of the clerk of court's jury tampering" while sitting at his trial, according to the
01:37 motion.
01:38 Despite arguing that there is no such requirement, the attorneys submitted an affidavit signed
01:43 by Murdaugh with the filing.
01:44 The motion also argues that the "very serious allegations" against Hill are not mere speculation
01:49 but have sworn evidentiary support.
01:52 The filing is the latest in Murdaugh's bid for a new trial following his March conviction
01:56 for the 2021 murders of Maggie and Paul Murdaugh.
01:59 After his conviction, he was sentenced to two consecutive life sentences with no possibility
02:04 of parole.
02:05 Murdaugh also appeared in court Thursday in a separate case, pleading guilty to 22 federal
02:09 financial charges for stealing millions of dollars while working as an attorney.
02:13 It is the only time Murdaugh has admitted guilt to a crime since his high-profile conviction.
02:18 However, on Saturday, Harputlian said in an interview that Murdaugh had always admitted
02:22 to the financial crimes and that Murdaugh's legal team felt that too much of the prosecution's
02:27 evidence during the murder trial focused on the financial misdeeds.
02:30 That jury had heard almost three weeks of evidence not related to the murder, to the
02:34 financial crimes, which he's always admitted to, Harputlian told Fox News Digital during
02:39 an interview at the CrimeCon 2023 convention in Orlando, Florida.
02:43 "But we believe it so prejudiced them that when we put the forensic evidence in, which
02:47 is very, very strong for his innocence, acquittal, they didn't hear it," Harputlian continued.
02:52 Netflix's true crime documentary Murdaugh Murders explored the killings of Maggie Murdaugh
02:57 and her son Paul Murdaugh, as well as a series of other incidents, including at least three
03:01 other deaths, linked to the Murdaugh family of prosecutors in South Carolina.
03:06 The events covered in the two seasons of the docuseries spanned multiple years and culminated
03:10 in the trial of Alex Murdaugh, Maddie's husband and Paul's father.
03:14 Alex Murdaugh stood trial for the murders.
03:17 In June 2021, Alex Murdaugh called 911 to report that his wife and son had been shot
03:23 dead on their property.
03:24 He was eventually arrested and charged, and in January 2023, he pled not guilty to the
03:29 two felony counts of murder.
03:30 "I did not shoot my wife or son, any time, ever," he told the court.
03:34 "I would never intentionally do anything to hurt either one of them, ever."
03:38 His surviving son, Lester Murdaugh, also spoke in his defense.
03:41 In March 2023, Alex Murdaugh was found guilty and sentenced to two consecutive life sentences.
03:47 He is currently serving out his sentence in a maximum security prison in South Carolina.
03:52 He is also charged with almost 100 other crimes, in addition to the murders of Maggie and Paul.
03:57 Alex Murdaugh has been charged with a huge number of other crimes.
04:01 Most notably, he has been charged with conspiracy to commit insurance fraud and filing a false
04:05 police report after hiring a man named Curtis Edward Smith to shoot him so that his son
04:10 Buster could collect a life insurance policy.
