00:00The Industrial Court has ruled that the decision by Taylors University to declare two associate
00:07professors, Tam Shih-Mei and Wong Ching-Li, surplus to requirements based on their high
00:12salaries, was unfair and discriminatory.
00:15Court Chairman Eswari Mari criticised the university's criteria used to retrench staff,
00:21saying they should align with existing policies and not be arbitrary.
00:25She said targeting employees solely based on salary is unjust and overlooks their contributions
00:31as well as undervalues their loyalty.
00:34Taylors defended its decision, citing financial losses and the need to reduce costs.
00:40Taylors said terminating higher-earning academic staff would be able to reduce costs more significantly,
00:45leading to fewer staff being released.
00:47However, the court found the terminations of Tam and Wong from employment were without
00:52just cause or excuse.
00:55Eswari ordered Taylors to pay Tam back wages of RM256,742, equivalent to 24 months' salary
01:03but subject to a 20% deduction for post-dismissal earnings.
01:07Wong was awarded RM276,480 on the same basis.
