00:00Namaskar friends, it's the night of 18th May.
00:02A 24-year-old man Anish and a 24-year-old woman Ashwini
00:06go to a club in Pune to party with their friends.
00:09Although they were from Jabalpur, Madhya Pradesh,
00:12but they were working in an IT company in Pune.
00:16The club they go to is called Ballar.
00:18And 3 km away from this place,
00:20on the same night, Vedant and his 12 friends meet in a pub called Kosi.
00:25It was 10.40 pm when Vedant and his friends entered this pub.
00:29And in just 1.5 hours,
00:31they spent so much money that the bill for food and water
00:34reached Rs. 48,000.
00:35The CCTV recording of this time is available for the public.
00:38In which you can see Vedant and his friends drinking.
00:41It's worth noting that Vedant is under 18 years of age.
00:44Way below the minimum drinking age limit.
00:47Around midnight, this pub stops serving Vedant and his friends.
00:52So these people leave this pub.
00:54A few kilometers away, they go to a club called Black in Marriott Suites.
00:59This place was also 3 km away from the club
01:01where Anish and Ashwini were partying with their friends.
01:05Around 2 pm, Vedant and his 2 friends leave this club.
01:10And in the intoxication of alcohol, they sit in their electric Porsche Taycan.
01:14The drivers of their house are also present in this car.
01:17Around 2.30 pm, Anish and Ashwini were returning home.
01:21Sitting on a motorcycle together.
01:23Their motorcycle takes a U-turn on Kalyaninagar Airport Road.
01:27And from the other side, Vedant's Porsche comes like a pistol bullet.
01:35A terrible accident happens and in a few moments,
01:37Anish and Ashwini die.
01:39According to some reports, the speed of this car was 160 kmph.
01:44So some reports say that it was running faster than 200 kmph.
01:49In the CCTV footage, you can see the size of this road.
01:52It's such a small road.
01:53After this collision, the airbags of this car open up
01:56and the people standing nearby reach this collision spot.
02:00After a few push-ups and questions,
02:02Vedant is handed over to the police by the people standing there.
02:06Thinking that in the crime of killing 2 people,
02:09this driver will be given the strictest punishment.
02:12But all these people were unaware of the strange things that were going to happen in this case.
02:17Vedant Agarwal is taken to Yerwada Police Station.
02:25And just an hour after this incident,
02:27MLA Sunil Tingde reaches the police station at 3 in the night.
02:32Think about it, friends.
02:33An MLA is waking up at 3 in the night and going to the police station for a boy.
02:38Will any MLA do this for an ordinary boy?
02:42No.
02:43Actually, Vedant Agarwal is the son of a very rich family.
02:47His father is a well-known builder, Vishal Agarwal,
02:50who owns the real estate company, Brahma Corp.
02:53Sunil Tingde is an MLA of Ajit Pawar's NCP,
02:56who is in an alliance with the BJP today.
02:59Tingde later tells News Laundry in an interview
03:01that he didn't reach there and influence this case in any way.
03:05He reached there that night because he has known this family for the past 30 years.
03:10And he considers the people of this family as his friends.
03:12That's why he went to help them because he was called.
03:16Actually, this call was made by Vedant Agarwal's father, Vishal Agarwal.
03:20The next afternoon, another interesting incident takes place at Yerwada Police Station.
03:24A Mercedes car comes.
03:26Some other cars come with it.
03:28And a man comes out of that Mercedes car.
03:30He has 6-7 pizza cartons in his hand.
03:33Some reporters outside the police station reported that
03:37a complete feast was being held inside.
03:39Pizza was being served.
03:41It's around 6 in the morning when Sunil Tingde comes out of the station.
03:46And a few hours later, at 8.26 am,
03:49on 19th May, an FIR is filed against Vedant.
03:53The section on which this FIR is filed is a controversy in itself.
03:58It is filed under Section 304A, not Section 304.
04:03There are some basic differences between the two sections.
04:05Section 304A is Death by Negligence.
04:08That is, someone died because of your mistake.
04:11This section has a maximum punishment of 2 years in jail.
04:14But on the other hand, Section 304 states
04:17Culpable Homicide Not Amounting to Murder.
04:20Culpable Homicide means that you knew that
04:23if you made a mistake, someone could die.
04:26And yet you made this mistake.
04:28Although it's not murder.
04:30That's why Culpable Homicide Not Amounting to Murder.
04:33Because murder has a direct intention of killing someone.
04:36Here, it's not that.
04:37That's why the maximum punishment for Section 304 is 10 years in jail.
04:41This is the biggest difference between Section 304A and Section 304.
04:45Your knowledge about your mistake.
04:47Do you know that someone could die because of your mistake?
04:50Or do you not know that someone could die because of your mistake?
04:54Now you tell me, friends.
04:56Is there anyone who doesn't know that
04:59driving a car while drunk can cause an accident and someone can die?
05:03Is there anyone who doesn't know that
05:06driving a car at a speed of 200 kmph on the small roads of an internal city can cause someone to die?
05:12That's why the question arises,
05:14why was Section 304A filed?
05:16And why wasn't Section 304 filed?
05:18Was there any influence of MLA Sunil Tingde in this recommendation?
05:22This is a very big question.
05:24Now if we talk about the car, there's a separate issue.
05:26The permanent registration of this Porsche Taycan was pending since March.
05:31Mr. Agarwal hadn't paid the fees of Rs.1758.
05:35That's why during the accident, this car didn't even have a license plate.
05:39We learn from Vedant's grandfather that this car was a gift for Vedant.
05:44When we come back to the FIR, a blood test of Vedant is done by the police.
05:48And the thing to note here is that
05:50at what time is this blood test done?
05:53At 11 in the morning.
05:54After about 8 hours of that incident.
05:57Now depending upon how much alcohol you've been drinking,
05:59alcohol remains in your bloodstream for 6-12 hours.
06:03Here, since the blood test was done after 8 hours,
06:06you might expect a positive blood test.
06:09But no.
06:10This blood test was negative and the reason behind it is that
06:13another fraud was committed here.
06:15The hospital in which this blood test was done,
06:17the doctor in which this blood test was done,
06:19he threw the real blood sample in the garbage bin
06:22and replaced it with another blood sample.
06:25That means this test was done on a sample which was already clean.
06:29The Agarwal family had given Rs. 3 lakhs to two doctors for this blood test.
06:34You can see this article on NDTV's website.
06:36According to its sources, Rs. 3 lakhs of bribe was given to the doctors
06:40so that they can change the blood samples.
06:42Their names are Dr. Ajay Tiwari and Dr. Shri Hari Halnur.
06:45Both of them have been arrested by the police.
06:48The effort to investigate doesn't end here.
06:50Look at this article from Pune Pulse.
06:52Vedant Agarwal's mother requested her driver
06:55to take the blame for this crash on her head.
06:58Vedant's grandfather went one step ahead.
07:00He threatened the driver saying that
07:02you will have to admit that you were driving the car that night.
07:05But thankfully, so many witnesses were present that night
07:08that no such stunt or attempt could be made.
07:11But the most shocking thing comes after this
07:14when the Juvenile Justice Board bails Vedant.
07:17While bailing, it is said that Vedant
07:20will have to study all the rules and regulations
07:23and prepare a presentation.
07:25Along with that, he wrote an essay of 300 words
07:28on the topic of road accident and dissolution.
07:30Here, he drove the car and killed two people
07:33and as a punishment, he is being asked to write an essay of 300 words.
07:37This was so shocking that when this news came to the public
07:40there was a ruckus all over the country.
07:42People started outraging on social media.
07:56A son of a rich family drinks and drives a Porsche car
07:59and kills two people.
08:01He is being asked to write an essay.
08:09Has justice become a joke now?
08:11And for the rich people,
08:13is our life's worth less than a cockroach?
08:16The public's anger put pressure on the police
08:18and for this very reason, the police
08:20moved the Sessions Court on 20th May.
08:22They tried to make Vedant look like an adult
08:26and to modify Section 304A to 304.
08:30The Sessions Court said in return
08:32that the police should approach the Juvenile Justice Board for this.
08:35Along with that, the police decided to book more people in this case.
08:38So, the owner of Cozy Pub, his father,
08:41the manager, he is being booked
08:43and along with that, the managers of the Black Restaurant.
08:45When three of these people were taken to the court for remand application,
08:50they give a very strange statement.
08:52They say, what will people do on the streets?
08:54People who come to big pubs,
08:56they can't walk home,
08:58they will drive home.
09:00So, the liquor seller should know
09:02how much alcohol he is serving his customers
09:04and a limit should be decided for that.
09:06Did you understand this logic, friends?
09:08That people who come to pubs will only drink and drive.
09:11You pub owners should pay attention
09:13to how much you are making people drink.
09:15In my opinion, this is a very strange statement
09:17because it seems like this was a way
09:19to remove the blame from Vedant and his family
09:21and put the blame on the pub owners.
09:23The mistake of the pub owners here is that
09:25they served alcohol to an underage boy.
09:28And for this, a fake ID card was shown by Vedant
09:31or they served alcohol without an ID card.
09:34This will tell us after the investigation
09:36that how much is their fault.
09:38Apart from these people, because there was pressure on the police,
09:40the police also file an FIR on Vedant's father, Vishal Agarwal.
09:44Section 75 is filed which is
09:46Willful Neglect of a Child or
09:48Exposing a Child to Mental or Physical Illness
09:50or Section 77.
09:52Supplying a Child with Intoxicating Liquor or Drugs.
09:55Apart from this, Section 3, Section 5
09:57and Section 199A is also filed
09:59of the Motor Vehicles Act.
10:01Vedant was allowed to drive a car without a license.
10:04On 20th May, there is another twist in the story
10:06when the news comes that Vishal Agarwal has run away.
10:09As soon as the son is given a bail,
10:11he tries to run away.
10:13A new SIM card is bought in this attempt
10:15so that the police can't track his number.
10:18But fortunately, this doesn't last long
10:20because the next day, on 21st May,
10:22he is arrested in Aurangabad.
10:24By this time, the outrage against this case
10:26had reached its peak.
10:28There was a lot of anger among the people.
10:29And the biggest politicians were raising this issue.
10:32The next day, on 22nd May, Vedant is produced in the juvenile court
10:35and another Section 185 is filed
10:38for driving under the influence of alcohol.
10:40The police then requests the court
10:42to treat Vedant as an adult,
10:44not as a minor.
10:46Now, it remains to be seen whether the court
10:48agrees to the police's request or not.
10:50Until then, Vedant has been remanded
10:52in the Nehru Udyog Kendra Observation Home
10:55in Yerwada, till June 5th.
10:58Here, we talk about an interesting
11:00legal technicality, friends,
11:02which makes it difficult to punish Vedant.
11:05We all know that when a criminal's age
11:07is less than 18 years,
11:09the punishment given to him
11:11becomes negligible.
11:12In the Nirbhaya case, there was a huge ruckus
11:14about this issue 10 years ago.
11:16Because a boy who had committed that crime
11:18was less than 18 years old.
11:20Under the pressure of the public,
11:21the government brought an amendment to this law in 2015.
11:23The Juvenile Justice Care and Protection of Children Act, 2015.
11:27According to this, in the age bracket of 16 to 18 years,
11:30if a person commits a heinous crime,
11:33then it is the decision of the Juvenile Justice Board
11:35that if they want, they can take him into trial
11:37not as a minor, but as an adult.
11:39Heinous crime means a very heinous crime.
11:42This is a crime where the minimum sentence
11:44is at least 7 years.
11:46For example, murdering someone.
11:48But in this specific case,
11:49in Vedant's case, the problem is that
11:51even section 304 of IPC
11:54does not give a minimum sentence for jail.
11:56The maximum sentence is 10 years,
11:58but there is no minimum sentence.
12:00That's why even in this IPC section,
12:02it is not included in the category of heinous crime.
12:05And coincidentally, Vedant's age
12:07is only 4 months younger than 18 years.
12:10In legal language, there is a concept of
12:12Dolly in Capex,
12:13i.e. the age of criminal responsibility.
12:16It is believed that children below a certain age
12:19can not intentionally commit a crime of their choice.
12:22That's why the punishment for children
12:24should not be the same as for adults.
12:27Most of the countries in the world
12:29use this philosophy in their legal system.
12:31However, how old they are,
12:33depends on the country to country.
12:35Some countries say that this age should be 6 years.
12:38Some countries say that it should be 9 years.
12:40Some say 12 years, some say 15 years.
12:42This is why when children commit a crime
12:44below a certain age,
12:45they are not given a punishment
12:47but they are given a means to reform themselves.
12:51Research proves that
12:53when children grow up in a bad environment,
12:55when parenting is not done properly,
12:57then the tendency of children committing crimes is high.
13:01But here, through counselling and proper education,
13:04these children also get a chance to reform.
13:07But what about boys like Vedant?
13:09A boy who grew up in a rich family,
13:11who got everything he wanted.
13:13Proper education, a whole family,
13:15all the privileges,
13:17even a Porsche car was gifted at the age of 17.
13:20That's why I believe that Vedant should not be kept as a minor,
13:23but should be kept on trial like an adult.
13:25But because of this one legal technicality,
13:27criminals like Vedant have already escaped.
13:30Look at this case of 2016.
13:324 days before his 18th birthday,
13:34a 3-time repeat offender, Juvenile,
13:36drives a car over a 32-year-old man in Delhi.
13:39First, the family's driver comes forward
13:41and says that he was driving the car.
13:43But later, he takes his statement back
13:45when he finds out that the victim died in it.
13:48In June 2016, the Juvenile Justice Board says
13:51that this boy should be kept on trial like an adult.
13:54And this was very logical
13:55because he was only 4 days younger than the age of 18.
13:58And he was also a repeat offender.
14:00He committed this crime again and again.
14:02But in 2020, the Supreme Court denies this
14:05by saying that Section 304
14:07is technically not a heinous crime.
14:10That's why he should be tried like a minor.
14:12Just a few days before this incident in Pune,
14:15another incident like this is heard in Kanpur.
14:18A 15-year-old boy kills two people
14:20in a motor accident in October 2023.
14:23Despite being charged with Section 304,
14:25he gets bail easily.
14:26This year, in the month of March,
14:28he once again commits a hit-and-run accident
14:30and kills four more people.
14:32Once again, Section 279338 is imposed on him.
14:35But he gets out of it very easily.
14:38Finally, he is arrested on 22nd May
14:41when the news of the Pune case was spreading on social media.
14:44And people were getting angry.
14:46I believe that if the law treats such people
14:48like a minor again and again,
14:50then all the responsibility should be put on the parents of these criminals.
14:54The parents who allow their children to drive
14:57at the age of less than 18 without a driving license.
14:59The parents whose children do such things
15:01because of their poor parenting.
15:03And the parents whose intentional mistakes
15:06cause people to go to jail.
15:08If you can't punish these 15-year-old criminals,
15:11then at least punish their parents.
15:13Because they were the adults
15:15who allowed their children to do all this.
15:17This Pune case, friends,
15:18exposes the entire system of our country.
15:20It exposes how this entire system is sold from top to bottom.
15:24Everything is fair for rich people.
15:26If you have money, you can do anything.
15:29You can drive a car without a license plate.
15:31You can drink alcohol when you are underage.
15:33You can drive the car at the speed of 200 after drinking alcohol.
15:36When you commit a crime, the MLAs will come to help you.
15:39When you bribe them, the doctors will change the blood samples.
15:42The court will ask you to write an essay in return for your crime.
15:45And everything will be forgiven.
15:47On the other hand, there are middle-class, common people and poor people.
15:50Even if a common man follows all the rules of the country,
15:53pays taxes on time,
15:54and is an ideal citizen,
15:56one day or another, he will face a bulldozer at home.
15:59I'm showing you the paper of the shop.
16:01No officer is coming forward to see it.
16:03If it's not legal, then leave it.
16:05No one is ready to see the paper.
16:06The Supreme Court has stopped the adomination.
16:08So why are you still leaving it?
16:10You're not even listening to the Supreme Court.
16:11Without any reason, the police will beat him up.
16:14One day, if he falls under a hoarding, he will suffocate and die.
16:17One day, if he gets cancer due to bad medicines and adulterated food,
16:21then one day, while walking on the road,
16:24a son of a rich man will come and crush him under his car.
16:28This is the life of a common man in our country, friends.
16:31There is only one thing,
16:32only one thing,
16:33which can reduce the distance between justice and injustice.
16:36Which can erase the difference between the rich and the poor.
16:39Something that cannot be bought with money.
16:43This is our unity.
16:45The voice of the people.
16:46In this case, a strict action is being taken against Vedanta.
16:50Doctors have been arrested,
16:51who tried to change the blood sample.
16:54If there is hope of justice in this case,
16:56then it is only because people raised their voices on social media.
17:00This system is not able to save this son of a rich father
17:03who left bloodstains on the road,
17:05just because of our collective voice.
17:08There is a lesson for all of us here.
17:10We should always raise our voice against injustice.
17:13If there is a way to fight this bad system,
17:15then this is it.
17:16As Dr. B. R. Ambedkar had said,
17:19Educate, Agitate, Organize.
17:21Spread awareness among people.
17:23Raise your voice.
17:24And show the power of your unity.
17:26Thank you very much.
