Transcript
00:00Investigation on Bataan Oil Spill, let's find out together with Undersecretary Raul Vasquez of the Department of Justice.
00:06Usec Vasquez, good afternoon.
00:10Good afternoon, Dale, and good afternoon, Usec Wing and Usec Dale.
00:16Yes, Usec, first of all, what are the potential violations that you see in the motor tankers
00:22that were involved in the sinking of their boat that caused oil spill in Bataan?
00:29If there are incidents like this, there are three possible sources of liabilities, criminal, civil, and administrative.
00:40The civil aspect, there are good news on that, Usec Dale and Usec Wing.
00:48The owner of MB Tanker Terranova, Shogon Shipping, and its insurance company, Steamship Mutual, and IOPC, Paqueos,
01:10Paqueos is a PNI member of Steamship Mutual.
01:13So this came out to immediately confront the civil compensation aspect of that.
01:24They have already been arrested by the local government of Bataan and Cavite,
01:32of which there are 31,000 residents or affected inhabitants of Cavite and 21,000 inhabitants or residents of Bataan.
01:45There are potential claimants there. It depends on the result of their submission of documents.
01:54Regular tenants are showing support because they are there to conduct assistance.
02:04They hired a salvor to have a chance to contain the oil spill because of that.
02:18At least, that's with Terranova.
02:22As for the two vessels, Jason Bradley and Mirola, Jason Bradley has a salvor hired by the owner.
02:36But we cannot talk about the case of Mirola because it fell through.
02:44Jason Bradley also fell through.
02:51So at least, on the aspect of civil compensation, there is clarity on that.
02:57As for the aspect of criminal and admissive liability,
03:02the fact-finding investigation of the three agencies that we have ordered,
03:08the NBI, the Philippine Coast Guard, and the marina is ongoing.
03:13Whatever the result of that fact-finding investigation,
03:17that will be the basis of the cases that will be filed against those who should be held accountable.
03:26Usec, what pushed you to investigate this?
03:30Is it true that the two of the three tankers involved in the oil spill in Bataan were already involved in oil smuggling?
03:38We cannot say that the conclusion is like that because it's still ongoing.
03:42It's a live investigation as we speak.
03:46But the history of Jason Bradley is involved in the investigation
03:54and we have a pending case of oil smuggling before.
03:59One tanker was caught with his crew and was charged.
04:14According to the investigation,
04:16there is a warrant of seizure issued by the Bureau of Customs against Jason Bradley.
04:34Our authorities are looking for this to implement this seizure.
04:43However, we found out that it was only in Mariveles when the oil spill happened.
04:52Usec, you mentioned that oil smuggling is possible.
04:57If that is true, if oil smuggling is real,
05:05how big is the loss to us and what is the effect on us?
05:11It's a huge loss.
05:14Yesterday, the BIR was here and was asked by our White Secretary,
05:24Secretary Jesus Crispin Emilia,
05:27the BIR to compute how much...
05:33We will return to DOJ Undersecretary Raul Vasquez later.
05:42Okay, Usec Vasquez.
05:49Yesterday, the BIR was here and was asked by our White Secretary,
05:58Secretary Jesus Crispin Emilia,
06:02the BIR to compute how much...
06:10There will be a problem with the line.
06:15Meanwhile, the Philippines and Singapore are hoping that

07:34which will be followed by the presentation of signed agreements and joint press conference.
07:39A state banquet is also being prepared for the Singaporean President and his house.
07:45This is the first visit of President Shanmugaratnam to the country
07:49since the former Singaporean President Halimah Yacob visited the country in 2019.
07:55The two leaders first exchanged greetings when President Marcos Jr.
07:59had a working visit in Singapore in May.

12:17Let's go back to Undersecretary Raul Vasquez of the Department of Justice.
12:21Usec, good afternoon.
12:23I'll just go back to the question earlier.
12:25If there is any truth to these oil smuggling allegations,
12:29how much will we lose and what is the effect of this on our countrymen?
12:40Usec, I think your audio is muted.
12:46Yes.
12:47We can hear you now, Usec.
12:50Okay.
12:51The effect of...
13:06We'll be back, Usec.
13:08We just had a technical difficulty.
13:12We'll be back later.
13:14Usec Vasquez of DOJ.
13:20We'll be back later.
13:22We just had a technical difficulty.
13:26We'll be back later, Usec Vasquez.
13:29On the other hand, the Department of Migrant Workers hopes that the financial assistance for the distressed overseas Filipino workers
13:37and their family members under the Action Fund,
13:41based on the DMW Department Order No. 0-5 Series of 2024,
13:46the financial assistance will depend on the situation of the OFW and their family.
13:52This includes P100,000 for the next-of-kin of the OFW who died abroad due to accident or natural causes
14:01and for the next-of-kin of the OFW who died within a year after returning to the Philippines.
14:08P75,000 for the OFWs who have serious illness, injury, or mental health condition
14:16and for the next-of-kin of the OFWs who are in the death row.
14:20P50,000 for the financial assistance for the OFWs who were severely affected or displaced
14:26due to the economic downturn or recession in the host country
14:30or for the OFWs who were victims of illegal recruitment and human trafficking.
14:34The DMW Action Fund provides financial assistance to the OFWs and their families who are in a critical situation.
14:42It can be used for legal, medical, or other assistance for overseas Filipino workers.
14:56Let's go back to Undersecretary Raul Vasquez of the Department of Justice.
15:01Usec Vasquez, good afternoon again.
15:05Good afternoon, too, Usec. What's happening?
15:09He's having technical difficulties.
15:12Problems with the technology.
15:14But Usec, I'll just go back to the question.
15:16If the oil smuggling allegations are true, how big will it be lost to us
15:25and what is the effect of this on our countrymen?
15:29It's big in terms of lost income and revenues of our government to our countrymen.
15:38Because if it's oil smuggling, they are not paying customs duties and tariffs.
15:45Second, because there are systems losses in oil companies,
15:54they are being transferred to our countrymen.
15:58So there are two sides to this.
16:03So it's a big thing.
16:05As for the percentage, what is the effect of this,
16:09our beloved Secretary Moying Remulia asked the BIR,
16:17because they were here yesterday to file a complaint about the unpaid taxes of Alice Guo.
16:25She asked the BIR to compute the loss of our government because of oil smuggling,
16:36if that can be proven.
16:38Usec, where are you doing your investigation on the possible involvement of oil smuggling?
16:45And what steps will you take to answer this?
16:51We are in the middle of a fact-finding investigation, Usec Weng.
16:57So we are trying to establish if there is really a basis to say that there is oil smuggling or if it really happened.
17:08We have to dig to the bottom of things so we can start filing a case.
17:16The good aspect of this is that there is a guaranteed payment for the damages of our countrymen affected by this oil spill.
17:2931,000 residents of Cavite and 21,000 residents of Bataan
17:36have the potential to receive financial assistance and compensation from the shipowner,
17:45its insurance company and the IOPC.
17:49So that aspect in Cebu has a clear result because of the task force that we started.
17:59But the second obligation regarding criminal and administrative matters,
18:06the investigation is still ongoing which we ask to be undertaken by the NBI, the Philippine Coast Guard and the marina.
18:18Usec, maybe you can send a message to our countrymen from your DOJ.
18:26Our message is that if you are affected by this oil spill,
18:35you should approach your local government unit so you can be included in the list.
18:43If there's a chance that you will be caught by your local government unit,
18:51you should tell them everything that happened to you.
18:58As for the local government units and the agencies involved,
19:03the first level of this investigation, ASEC DIL and ASEC WENG,
19:09is the containment.
19:11This is done by the Philippine Coast Guard,
19:14along with the owner and the towage company hired by Sugon Shipping,
19:24which is owned by Terra Nova.
19:25It's the same with Jason Bradley.
19:28The containment is done first so that the affected area of the oil spill will not spread more.
19:41Second is the establishment of compensation.
19:47I have already done that.
19:49Third is the fact-finding investigation if that is the basis to initiate criminal and administrative charges against anyone.
19:57Similar to what we did in the case of the Mindoro oil spill.
20:01That system became a template.
20:04The good result is that for the first time in Philippine maritime history,
20:10there is a certain way to at least pay for the oil pollution in our seas.
20:24Thank you very much, Undersecretary Raul Vasquez of the Department of Justice.
