The High Court in Ayer Keroh, Melaka freed four men and a woman of drug trafficking and possession charges on Thursday (July 27).

Judge Mohd Radzi Abdul Hamid reached the decision after the prosecution failed to prove a prima facie case against the five accused at the end of the prosecution’s case.

00:14 a prima facie case against Mahmoud Nizam Magzan, aged 34, Noshahira Hamraj, 27, Hairuddin Ramli,
00:23 24, Mohamed Humey Rosli, 33, and Dermawan Mohamed, aged 38, at the end of the prosecution's case.
00:31 Delivering his judgment, Mahmoud Razzi said the prosecution failed in proving the element
00:36 of possession, thereby also failing in proving the elements of trafficking and possession.
00:42 Therefore, the five accused were discharged and acquitted from the four charges.
00:47 The five friends were jointly charged with trafficking 166.24 grams of methamphetamine
00:53 and also faced three counts of possessing heroin, morphine and ketamine at a house in
00:59 Jalan Semabok at about 1am on March 22, 2018.
01:04 The trafficking charge was filed under Section 39, Subsection B, Subsection A of the Dangerous
01:10 Drugs Act, 1952, which is punishable by the death sentence upon conviction.
01:16 The possession charges were filed under Section 12, Subsection 2 of the same Act, which is
01:21 punishable by up to five years' imprisonment, a fine of both upon conviction.
01:27 The prosecution had called in 11 witnesses to testify during the proceedings.
