00:00 A post-nuptial agreement between a business tycoon and his Singapore-born wife, which
00:06 allows him to keep a mistress during their marriage, has been declared as valid.
00:11 The Kuala Lumpur High Court said the couple, whose identities were anonymized, entered
00:15 into the accord in August 1997, a month after their union.
00:20 Justice Everill Marriott-Peters said such agreements between non-Muslim spouses hold
00:24 statutory recognition under Section 56 of the Law Reform, Marriage and Divorce Act,
00:30 1976.
00:32 The wife, who petitioned for divorce, argued that the agreement was not enforceable as
00:36 she had executed it in ignorance and under pressure and duress.
00:41 However, Peters rejected her plea of ignorance, noting that she had signed the agreement in
00:46 the presence of witnesses and initialed every page.
00:49 The judge also said the wife was not entitled to rely on Section 54(1)(a) of Act 1976 to
00:56 cite adultery as the cause of the breakdown of their marriage, as she had tolerated the
01:00 husband's infidelity.
01:02 She filed for divorce, seeking maintenance for herself and two children, equal division
01:07 of matrimonial assets, and damages from a correspondent identified as Jen, accused of
01:12 adultery with her husband, leading to the marriage's breakdown.
