Comelec, may 'fact-finding committee' kaugnay sa kaso ni suspended Mayor Alice Guo
Transcript
00:00The Law Department of the Commission on Elections is now forming a fact-finding committee after their investigation involving suspended Bamban Mayor Alice Guo.
00:11Attorney John Rex Laudianco, the spokesman of Comelec, is the one who conducted a technical examination of the fingerprint and handwriting in their records of Guo.
00:22They expect that their Law Department will issue a recommendation to submit to the Commission and Bank where they will see if the collected information is sufficient to see if they have a law for Guo's election.
00:37If there is one, the commission will file a complaint for material misrepresentation of election offense and criminal case,
00:47which will be followed by a preliminary investigation where the respondent will give an opportunity to explain the due process.
00:56If there is a probable cause for violation of the election law, it will be followed by filing of criminal information to the regional trial court.
01:05You might ask, why to the RTC? First of all, it is the one who passed the law according to the Omnibus Election Board.
01:11Second, because the election offense involves imprisonment of one person up to six years, there is a violation of the right to vote,
01:18there is a perpetual disqualification to hold public office, the court should make a decision on this.
