00:00A federal court review panel upheld a former tow truck driver's death penalty for the

00:06murder of Arab-Malaysian bank founder Hussein Ahmad Najadi 11 years ago.

00:11The three-member bench, chaired by Justice Harmindar Singh Dhaliwal, deemed Kung Swee

00:16Kwan's death sentence appropriate, citing the execution-style killing and its shocking

00:21impact on society.

00:23Despite arguments for mercy and compassion, the court found no exceptional reasons to

00:27exercise judicial discretion to overturn the sentence.

00:31Kung had sought a review under the revision of the Sentence of Death and Imprisonment

00:35for Natural Life Act 2023 that allows for reduced sentences.

00:40The 55-year-old, who was convicted of shooting Najadi in 2013, can still seek a pardon from

00:45the young Deepertwan Agong.

00:47Three years ago, the federal court dismissed Kung's final appeal, saying the trial judge

00:52had given due consideration to his defense.

00:54The court also upheld his 18-year sentence for the attempted murder of Najadi's wife,

00:59Chong Mee Kuen.
