00:00Now, let's talk about patient privacy.
00:03This is one of the hot topics on social media, Fee.
00:08It's a well-known topic.
00:09After that, there were spread videos of a fight here
00:13and the patient's information was spread without an end.
00:17Let's know the laws about this and the rights of each one.
00:21When it comes to this situation,
00:23let's go back to Dr. Villa Roderos Galván, a general physician.
00:27Dr. Villa, good morning. Welcome to Rise and Shine Pilipinas.
00:29Good morning.
00:30Good morning, Prof. Fee, Sir Audrey.
00:32Good morning to all of our viewers.
00:35Okay.
00:35For our fellow countrymen, Dr. Villa,
00:39what does patient privacy and protection mean
00:43and why is it important for patients?
00:46When we talk about patient privacy,
00:49it's an important component of healthcare
00:52wherein we protect sensitive information about our patients.
00:58Under this particular premise,
01:02we have two guidelines.
01:07Especially for us, as doctors,
01:09we have our Code of Ethics for Physicians.
01:12What's written there,
01:14especially in Section 2 of our Code of Ethics,
01:19all the information that patients give and volunteer to you
01:24is sacred.
01:25Okay.
01:26You should treat it with utmost respect and confidentiality
01:31because this information was given out of trust
01:36in your relationship as doctor and patient.
01:39And another law or another guideline that we abide by,
01:43especially when it comes to patient protection,
01:46is the Data Privacy Act.
01:48Okay.
01:48Actually, our Data Privacy Act provides protection for our patients.
01:53So data privacy or patient privacy and protection
01:57pertains to any sensitive information
02:01that should be protected with regard to our patients.
02:04There.
02:05Doc, I just have a clarification because you mentioned Code of Ethics, right?
02:08Yes.
02:09Although it's ethics, it's just a moral philosophy.
02:11It means we're going to follow it.
02:14If not, you can't be punished.
02:17But on any cases, we're talking about the Code 2.
02:21Is there a law anchored here
02:23or is it the data privacy that can be used here
02:25to be punished?
02:27Yes.
02:28It's good that you brought up our Code of Ethics.
02:31Although there's no criminal liability there,
02:34you can still go under, of course, the scrutiny of PRC.
02:38There are regulatory boards.
02:40You can have an administrative case.
02:43You can also have a chance to lose your license because of it.
02:49But in terms of criminal liability,
02:51our patients are protected actually by the Data Privacy Act,
02:55which also entails penalties if you have breached sensitive information
03:01or depending on what kind of breach happened.
03:04Which is what we call the privileged or should I say protected health information.
03:08Yes.
03:09What are the examples?
03:10Here are some examples.
03:11Okay.
03:11So when we talk about patient protection or protected information,
03:16we have to establish first doctor-patient confidentiality.
03:20So it means that everything that goes and transpires
03:23between the doctor and the patient is protected,
03:26including your identity as a patient,
03:30what is your case,
03:32is there going to be a procedure that's going to be related
03:35to the disease that we are curing.
03:38So especially if you're not in the healthcare team of a patient,
03:43we are not allowed to disclose even to our family members,
03:47even to our colleagues also,
03:49especially those who are not part of the healthcare team of the patient.
03:53Because we are bound by not only by the code of ethics,
03:56but of course, patients are protected by the law.
04:02To follow up on the question of Fino,
04:05because it's not just documents, doctor,
04:07we have cell phones that we can video call.
04:10For example, if the patient is a celebrity
04:13or a high-ranking official in the government,
04:16and it goes out to the public,
04:18and the public is concerned and scrutinized,
04:20the public will...
04:21The media circles.
04:22Yes.
04:23So is this also against the code of ethics and the law?
04:28Yes.
04:28So to err to the side of safety,
04:32usually we follow up if we have to protect the identity of the patient,
04:36that's why usually in hospitals,
04:38we always have reminders to the patients that they are not allowed to video call,
04:44they are not allowed to take pictures,
04:46because what the law, the spirit of the law is after
04:50is to protect the dignity of the patient.
04:53So ideally, if for example,
04:57there's a face that comes out,
04:59there's a name that comes out,
05:02usually this should not happen.
05:06So anything that would concern the patient,
05:09and the doctor itself,
05:11that should not come out,
05:12because under the data privacy act and code 2.
05:15Unless of course, consent.
05:18Consent is important.
05:19Consent, sure.
05:19Of course.
05:20How about the medical history of a person?
05:23Of course, if there's an official running around in the government,
05:27their history is scrutinized,
05:29even their health.
05:30That should be said, right?
05:32So how is this?
05:33Usually, when we talk about medical history,
05:36it's under still the sensitive information
05:41that we do not have to disclose.
05:43Especially if we tie it to an identity.
05:46So for example,
05:48in the case of, for example,
05:50we will present a case study of a patient,
05:54we would redact the information about their name.
05:58Yes, when it comes to research,
06:00we really don't name it.
06:01Especially, there should be consent.
06:03If it's a high-ranking official,
06:05it should be said to the public,
06:07it's a spokesperson.
06:08That's why the media can ask.
06:10Aside from the doctors,
06:14who are the ones who need to follow the rules of
06:18what we call patient privacy and inprotection?
06:21Are they all employees of clinics and hospitals?
06:24Is this across the board?
06:26Yes.
06:28Since there is a law that protects patients,
06:32it's across the board.
06:33So any healthcare professional
06:37under the jurisdiction of a surgeon,
06:40even interns, especially interns,
06:44because one of the things that we usually teach
06:48our medical professionals,
06:50our medical students,
06:51before they graduate,
06:54is patient privacy.
06:57That's part of our medical jurisprudence
07:00that they have to pass before they graduate.
07:03So, including medical trainees,
07:06have to abide by the law
07:08and have to abide by the code of ethics.
07:10Alright, thank you very much for all the information
07:12that you shared with us this morning, Dr. Ravia.
07:14Again, we have Dr. Ravia Arderos-Galvan
07:19to talk about private information
07:23to patients.
07:25Thank you very much, Doc.
07:26Thank you so much.
