00:00Good evening everyone. Welcome tonight to the 18th regular session of Kenton City Council and can we have the roll call?
00:12I would ask all who are able to please stand. We'll begin with the prayer and then the Pledge of Allegiance.
00:39Heavenly Father, you promised to open doors of blessing and abundance for your people. We ask for your powerful presence within us tonight.

01:34We have quite a full agenda this evening so let's get right to it. Does anyone have any additions or corrections to the minutes as they were provided for you?

01:59We do have fairly full seats here tonight. No one on the agenda ahead of time but you will have time to address council toward the end under public participation.
02:12I'll also give anyone an opportunity for a quick word if they are speaking on behalf of some legislation. We can get to that right before we go into ordinances and resolutions.
02:27Communications. Two items were in your packet. Hardin County Chamber and Business Alliance September Economic Development Report.
02:37If you have any questions, there are some interesting items in there. Read through that if you have any questions. I'm certain Holly would be happy to answer any concerns you have or clarify things in there.
02:49ODOT award letter. I think Cindy will talk a little bit more on that when we get to her report under administrative reports but some really good news there.
02:57Petitions. We do have a liquor permit that we will get to in new business that we're going to have to just slip in here tonight because they want an answer by the 15th so we'll get that in new business.

04:20I would say Chief Musser did have two reports in here. I didn't give you credit on that.

04:38So there's a report in there from Mike. Some of us went down and took a tour of the sewer plant with the drought that was going on until last night.
04:51Things have been going very smoothly down there. No bypasses.
04:58Like Joel mentioned, we got awarded a small cities grant of $2 million from ODOT to finish North Detroit Street.
05:11So this will take us from Eliza Street to the Corporation Line and that will be in 2028.
05:19So it's a ways out there. So we'll keep shooting for some additional funding that would be doing the water line and storm sewer that runs along that area too.
05:35The only other thing I have is, I'll talk about that when we get down to the meetings.
05:41Just let me give you an update out here. They're doing five. I thought they were only going to do three, but they're doing five projects going on out there, five digs.
05:55So what they're basically doing is, there's areas where we need to set catch basins, but the old water line is in the way.
06:05So they are chunking out the old section of water line, capping those ends. That will be replaced when we go and do Phase 2B up here.
06:14When we do Franklin and Columbus, so that we can finish putting catch bases in and finish pouring the curbs.
06:21So it's going very well so far.

08:33Our options are we can request a hearing either in the county seat or in Columbus, or we just waive a hearing.

08:56We do have a couple council members, so I know Dave knows the process very well.
09:00But when we have these types of issues going on, the purpose of the hearing would be to present evidence of why the permit should not be issued.
09:11It is not just to merely ask questions.
09:14So if we feel we don't have a reason why Casey's should not go, and I mean I think they're a fairly reputable corporation.
09:23I always feel there's no need.
09:25Now, the reason is if we have somebody applying that has some criminal history or history of violating liquor permits,
09:34and we always kind of look to the police department a little bit to see if they can provide us guidance on that.
09:39But that would be a reason where we would request a hearing and say.
09:42And then we'd be putting on evidence before the Division of Liquor.
09:47So without that evidence, my technical recommendation is to not do a hearing.
09:52I know this because we did do one a number of years ago, and just we didn't have the evidence there.

12:09There is items that's permitted use, and keep in mind this was enacted in 66.
12:17Some of these things you don't even necessarily do anymore, okay, so some might not be applicable.
12:24So I'll go through some of these, although the list is 48 long, and if people want me to keep going, I can.
12:33So these are the things that are permitted, and some of the stuff I might mispronunciate, so bear with me.
12:41I'm not a scientist.
12:44I'm kind of an attorney.
12:46So assembling, manufacturing, acid manufacturing, except there's certain kinds that require conditional use.
12:55Asbestos manufacturing, again, that's one of those that I'm not sure you're going to see anymore.
13:00Automotive assembly, bleaching, cleaning, dyeing.
13:04Boiler shops, machine shops, structural steel fabrication, railway car locomotive shops, including repair.
13:14Candle or sperm oil manufacturing.
13:18Coal yards, cooperative works, dextrin, starch glucose manufacturing, disinfectants, insecticides, poison manufacturing.
13:27Dye and dye stuff manufacturing, enameling, lacquering, or japanning.
13:33I don't know what that is.
13:35Emerald cloth or sandpaper manufacturing, felt manufacturing, flour or grain mill.
13:40Forgery or founder works, gas generation storage, grain drying, poultry feed manufacturing, hair and hair products manufacturing.
13:50Junk yard, lime-lime products, linoleum oil cloth, oil goods manufacturing, match manufacturing, meat packing.
13:58Oil paint, shellac, turpentine, varnish, enamel.
14:02Paper and pulp manufacturing, perfume manufacturing, pickle, sauerkraut, sausage manufacturing.
14:09That's a strange one I find in this.
14:12Plaster manufacturing.

14:18Poultry slaughterhouse, printing manufacturing, radium extraction, sandblasting, cutting.
14:25Sawmill, manufacture of wood, sawdust particles, sewage disposal plant.
14:32Shoddy manufacturing.
14:36I don't know, that must be a term.
14:39Shoe blackening or polish, soap manufacturing, steam power plant, stone and monument works, power driven tools.
14:48Storage, drying, cleaning of iron, junk, rags, glass, cloth, paper, clippings, including sorting, refining, baling.
14:56Sugar refining, tar asphalt roofing or waterproofing, tar distillation or manufacturing, vinegar manufacturing.
15:04Wire or rod drawing, nut screw, bolt manufacturing, yeast manufacturing.
15:09So those are the things that are permitted.
15:12And then there are certain things that would require the Board of Zoning to approve.
15:18So again, that list of items or similar items would be outright approved in an M2 without further approval from City Council.
15:27But then the additional things, it's a heightened level.
15:30Ammonia, chlorine, bleach powder manufacturing, animal, black, lamp black, bone black, graphite manufacturing.
15:40Again, the list goes on and on.
15:42So I don't know.
15:43Those would require a full process again.
15:46Right, so the Board of Zoning Appeals would have to approve it as a conditional use.
15:51So that first list are the ones that they don't need a permit to do here.

19:25this is applying with the EPA this first one is for North Detroit Street between
19:31Carol and Eliza Street so the one that will be constructed 2025 next next
19:37summer and can you give that one briefly what is this one do this piece of
19:46legislation so it's asking for for the EPA to either consider us for some
19:53principal forgiveness or loan money to yes to construct the stormwaters storm
20:05sewer system along North Detroit Street there is a deadline with with respect to
20:13getting that application getting that timely in the EPA schedule it's present
20:19I do for suspension of the three-week rule for resolution number 0 1 8 dash 2

22:07a siphon that goes underneath the river from village pantry it will eliminate
22:12that siphon and we'll be taking village pantry out to join up on Decatur Street
22:18so eliminate one of our siphons same thing we're under the same similar time

26:18this isn't really forming a new district but they had some reorganization that
26:23was required no urgency on this so it can go to a third reading if there are
26:30no objections that's what we'll do okay
26:40and resolution and number 0 1 7-2 for a resolution accepting the amounts and
26:46rates as determined by the Budget Commission and authorizing the necessary
26:53tackle the tax monies and certifying them to the County Auditor we passed

28:11Jones Road in the city of Kempton Ohio owned by the Board of the County
28:15Commissioners of the Garden County Ohio from our one one and two family
28:19residence district to end to a general manufacturing district any last
28:26questions from Council or any comments from administration no I we haven't had
28:38a motion yet I just want to know if there are any questions if no one moves
28:44emotion it'll it'll die 24-0 to 24-0 to the move by Chad's there a second
28:59I'll second second by Steve is there any discussion I do have a discussion I guess
29:07go right ahead so I mean I'm not sure where everybody else feels like they're
29:12at on this I feel like there's a lot of the industries John named off as far as
29:19that could go in there there is really some you know poisonous acid things like
29:26that that's that's some like big-time stuff that we're kind of feel like we're
29:32being asked by the commissioners to buy a used car over the phone with not
29:37letting us know really what's going in there I don't feel comfortable approving
29:44a rezoning on it with that not being on the table as far as even you know it's
29:5156 acres if you look around town just the things that's been in isolation from
29:57Broderick's to Andover's down there to Kenton Ironworks I know they're not 56
30:04acres but them have been isolation businesses that hasn't sustained and
30:09they've turned into brownfield so and a big thing for me is we're trying to
30:15correct truck traffic going north and south and we're gonna approve we're
30:20being asked to approve a single business on the west end of town that's then in
30:26turn going to create traffic that needs to sit at this light and turn west to go
30:31to one single business as well as come in and kind of create that turning here
30:38it's gonna it kind of goes against what we're trying to create with controlling
30:43truck traffic to town as it is for what we don't know I mean we just don't know
30:49to say for me to try and sell it as creating jobs and revenue for the city
30:55is kind of fool's gold in its own right because we don't know what we'd have to
31:00spend on infrastructure to support that business we don't know you know if it's
31:0510 employees for a warehouse how much revenue we're gonna really see back for
31:13just rezoning it I mean to me there's too many unknowns and we'd be opening
31:18a can of worms for just the truck traffic that we're trying to alleviate
31:22now as well as the business is unknown of what's going to go in there and I
31:29know Tim and Faith have been like the face of opposition so to speak but this
31:36petition was signed by every resident out there so it's not like it's just Tim
31:41and Faith this has been you know they may not come and represent but it's not
31:48a single family asking us so I mean I'd encourage anybody else they have any
31:54input to put it in I've kind of spoke my piece on it I feel like we struggle to
31:58support the job industry we have now with getting good quality people into
32:04the places that are existing here now and we have quite a few storefronts that
32:09just sit empty as it is that we're not backfilling with businesses to be asked
32:15to rezone a perfectly good farmland for an unknown to me is I mean I'm tipping
32:23my hand on how I'm gonna vote but that's just that's where I'm at with it
32:28I don't know you know I succumb the floor to anybody else on council other
32:34discussion I did talk to some of those people that petition said the petition
32:42and we do have an industrial apartment from what I understand there's some
32:46buildings out there that are empty at least one that I know of and there's
32:49land out there that can be bought to put a bigger manufacturing place so I was
32:55concerned about what we've been waiting to do for years the downtown
33:00revitalization and we don't want to push more traffic to turn uptown so that's
33:09where I'm at with it other discussion
33:15if they if they decide to come back to us and say this is what we're going to
33:21put in this is how many jobs it's going to create this is a safety five rated
33:26star facility we can revisit this down the road in five years or ten years or
33:31twenty years in other words it and they can file a new application next week and
33:39then it has to go through the same process there's no statute limitations
33:44or staff statute of repose saying they have to wait so long so just if they
33:49want to do it again we have to go through the same process which is get
33:52into the Planning Commission public hearings and before council process is
33:56the same they want to file an application next week they can now I
34:00think without having new information if it were voted down I don't think that
34:06would be probably not a good way use of time but if they do have a buyer then
34:11you know they couldn't file immediately there's there again there's no
34:15limitation on us reconsidering this in the future I would have been much more
34:25comfortable if we had more of an idea what they really were going to put in
34:29there I would have been maybe more inclined to an m1 which is more light
34:36you know I'm concerned about environment things and but I would be more
34:44comfortable if they would come back and we know something is really interested
34:49in that area that they can say what it is rather than just maybe
34:59John's are valid points I'm sorry no go ahead and I'll have John clarify
35:04something those are valid points about not knowing
35:10but you're handcuffing the economic development people by saying we're going
35:18to leave it at a certain level and then go through the petition process a second
35:25time and they can only hope that the prospective buyer would then be approved
35:29based on that there is another layer of protection that's not been talked about
35:35to any great degree but the transfer of the property would have to go through
35:39CIC unless they open it up for bid oh well that's true you know that's true
35:49but yeah they're just gonna direct sale then it would have to go through this
35:53and CIC would then have some regulation over accepting or not accepting the
35:59transfer of the property based on particulars of the industry that might
36:04be elected to try and purchase the property so there is another safety net
36:10there for some of the concerns that so the CIC though it's like he said it's
36:16not guaranteed if they choose not to use it you're correct I mean we would be
36:20ultimately and and I'm not I'm personally not one to defer my
36:27responsibility to the to another entity so to speak I feel like it's our
36:33responsibility to decide this as far as this is what this is what we signed up
36:38for I mean to I don't want to call it a cop-out but the cop-out or whatever and
36:43say well this the CIC will take care of it that's not a guarantee for me
36:50last comment statement John do you want to clarify a little bit so it was
37:01mentioned Sue mentioned something about you know the other manufacturing how
37:07does zoning work as you let's say you put it at an M2 what about things of
37:17lesser you're allowed to yeah you're allowed to use the lesser yeah except
37:22for residential uses right they could yeah but houses right just want to make
37:28sure everybody knew that okay any other it could just be warehousing for one of
37:33the existing companies like say I'm not saying graphic packaging for example say
37:37they wanted to have another area which is pretty non-objectionable that could
37:42go in m2 you know so you can always go less again just the restrictions not
37:48residential been plenty of discussion is only a couple council members haven't

39:34execute contracts as required in the current emergency
39:37so you just remind this what this is compared to everything else okay so this
39:42is new opwc so it's asking for money again for the sanitary sewer trunk line
39:50a second funding yes right but it's the same trunk line yes but it's a second
39:58funding source and this is a third reading mr. president I move for the
40:04adoption of revolution resolution number zero one five dash two four

41:48Terry Billen Stein and I'm here to read a letter from a friend who is under the
41:54weather so this is about pedestrian crosswalks friends and to whom it may
42:05concern the Ohio Department of Transportation has apparently decided
42:11for some reason that using traffic control signal lights to protect the
42:16lives of crosswalk pedestrians on Detroit Street at Ohio Street is waste
42:21of money the principal purpose of all the traffic signal lights in Kenton is
42:28providing critical safety separation space between unprotected crosswalk
42:33pedestrians and motor vehicle traffic there is no highway safety engineering
42:40justification for ODOT intentionally mixing crosswalk pedestrians with heavy
42:46commercial truck traffic removing these traffic signal lights is a monumental
42:52detriment to crosswalk pedestrian safety
42:56incredibly no discussion of pedestrian crosswalk safety can be found in the
43:032023 excuse me ODOT CMT City of Kenton safety study nor anywhere in the 2024
43:12ODOT TRC roundabout feasibility study since ODOT district one disregards
43:18specific public record requests I request from the City of Kenton the
43:25public record of the Ohio State traffic signal light removal study also known as
43:31the quote study for the removal of the signal lights on Detroit Street at Ohio
43:37and Carroll Streets unquote I also request from the City of Kenton pages 6
43:45and 7 of the 2023 ODOT CMT City of Kenton safety study my contact
43:53information is included with my credentials presented to the city and
43:58City Council on July 22nd of 2024 that Gardner Kenton Ohio I have copies of
44:06this for all John what do we need to do to formalize that request I'll just give
44:17a copy of that letter to Cindy just so we have specifically the information
44:23needed sure if we can if we can run that right after the meeting that you
44:28know just so we have or if you have an extra copy that's that will suffice you
44:33know

46:11straight really yeah so the water tower the painting has begun on the water
46:16they should be back in this week to weld the plate shut on the top and finish
46:25that project up so we're it's going everything's going great so far
46:29so it has been drained yes it has been drained cool did they notice yep
46:39obviously that being said we are starting the grinding and paving of the
46:50streets and one of the tanks is sitting on one of the streets that room so
46:55that's why we're hoping to get it done and get the tank moved before we go to
46:59mill that street down but that should be starting this week and the paving should
47:05be done next week so all right mayor Lynn Webb I don't have anything okay
47:23well appreciate everyone's attention awful lot to get through tonight and we
47:27got through it really appreciate council's thoughtfulness and really
47:34researching all that they needed to on some of these items now this is a three
47:41week break here so we're back on October 14th and it's probably time to for me to
47:48start reminding people take your vitamin C and all your other vitamins we don't
47:53need you missing meetings in late October and November and December
47:59because we've got to get a budget passed and we didn't need that budget
48:04because apparently Cindy has nothing to do so we better Wow I don't know how
48:12you're doing so many things at one time so let's yeah everybody if you have
48:17questions especially we get in the budget see finance committee reach out
48:21to Lynn reach out to Cindy and they will get those questions answered or better
48:26yet go to finance committee meetings I know it's another meeting but and that
48:30next one will be October 14th at 6 and our regular meeting then we'll follow
