00:00:48Dear Lord, we are here to discuss topics that will benefit the people of our community. We want to think about how we can make it easier for everyone. Come and give us the wisdom to make the right decisions. Let us not make biased decisions, but decisions based on solving the problems of the City of Kenton. Be our leader during this meeting. Show us the way because you have chosen us to be here.

00:01:48Again, welcome everyone and I have a pretty decent agenda here, so bear with us and we'll try to get through it.
00:01:59Begin with approval of the minutes of the prior meeting. Are there any additions or corrections to those minutes from July 22nd as they were submitted or included in your packet?
00:02:12Hearing none, they'll stand approved as submitted.
00:02:16We do not have anyone on the agenda this evening. There will be time, however, for anyone that would like to address Council and address the Administration at the end of our meeting under public participation or comments from the public.
00:02:33So we'll move on to communications. Two in your packet. The Hardin County Chamber and Business Alliance report economic development report for August. That is in your packet.
00:02:48There's also, we have a TREX application. We'll come back to that. Because we actually have to make a decision on that.
00:02:58So any questions on the Chamber and Business Alliance report? If you do, Holly can definitely answer those.
00:03:07I would also say that Councilman Walters and I did receive an email from a resident regarding the roundabout. I'd be happy to share that with you all if you would like to see that.
00:03:19That email was expressing concerns about the roundabout and the traffic study. Am I remembering that right, Steve?
00:03:28I think so, yes. The traffic study, yes.
00:03:30So if you'd like, we can just forward that to you all if you'd like to see that.
00:03:37Alright, the TREX application. John, you want to?
00:03:41Yeah, so last week Casey's Marketing Company had reached out to me asking that we seek Council approval of a TREX permit.
00:03:53A lot of folks here on Council, I think we've only had maybe one or two members that were here last time we had a TREX permit.
00:04:02So a TREX permit is when they're out of quota. You only have so many liquor permits based upon population.
00:04:09So we don't have the permit that they're needing, which is just basically a convenience store permit, where we're used up in the city.
00:04:18So what they do is, this is a legal process through the Ohio Department of Commerce.
00:04:23They can, what's called TREX, or bring a permit from another jurisdiction that has excess permits.
00:04:29But they have to show that it's in job creation. They're creating new jobs.
00:04:34So here would be Casey's convenience store. They'd be building a new, and then they would have employees.
00:04:40So all we're doing, we're not approving the business or anything.
00:04:44All we would be doing is approving, saying we will allow that permit to be transferred.
00:04:50And then they still need to work through the state to get that process finalized.
00:04:55Without that, they inevitably would not locate in the city.

00:05:05Can you clarify what a C1, C2 is, please?

00:05:09Packaged goods.
00:05:10Yes. And that's what you typically see on a convenience store.
00:05:14Off-premise consumption.

00:05:17It's not for a bar. Those are more your D permits.
00:05:22And, of course, they have to comply with the police requirements.
00:05:26And, you know, if there's underage alcohol or violations, they can lose their license, as with any liquor license holder in the state.
00:05:35So that's what we would be voting for today.
00:05:38There's no legislation. We would just do a roll call for the vote.
00:05:44And, again, that's just saying that we would allow...
00:05:47We're okay with the TREX process.
00:05:49The permit does not move forward without the city doing it.
00:05:53We can always weigh in on renewal of the liquor license if the liquor license is granted.
00:05:59But this does not move forward if we don't approve the TREXing process.
00:06:03Because we're saying we don't want another permit in town.
00:06:08Did I also see indication that there would be a vote in the township for that particular location?
00:06:16For Sunday.

00:06:24And you saw, you see in the application, the application includes some economic development type numbers there in Section E
00:06:34where they are estimating their total investment in the project and the amount of taxes that would come in as a result of the project.

00:08:23Update on the ladder truck.
00:08:25Atlantic Emergency Solutions Service Center up at Findlay.
00:08:29They're working through the process with E1 and the manufacturer of the swivel, so they're in the process now of, I guess, trying to find out if there's other problems causing the problem with the swivel.
00:08:45So we are actually starting to make some progress towards some sort of resolution at this point in time, but timeline-wise I don't have anything at this point.
00:08:55But at least the two entities that need to be talking are talking right now.
00:09:01So we are making a little bit of progress on that front.
00:09:06Hydrant inspections have been wrapping up.
00:09:09I know the guys have been breaking loose some caps and stuff that have been stuck and trying to work on some of the top nuts that are sticking to open the valve or the hydrants up and stuff.
00:09:21They've been progressing through that through all the wards.
00:09:25I don't have a definitive timeline on when they'll be wrapping up the total fixes, but we're working through them.
00:09:33The ones that are still wrapped are out of service.

00:09:36What is our timeline on replacement?
00:09:38I know we've talked about those dollars.
00:09:43Most of the ones that are wrapped are probably going to be with the guys from the street and water department.
00:09:51So it's probably kind of whatever frees up for their schedule to be able to try to get those.
00:09:55We need to know for sure if you guys could work together and make sure that that is actually true because they are very shorthanded.

00:10:02So the ones that are bagged up have to be completely replaced?
00:10:07I don't necessarily know that they have to be totally replaced.
00:10:10There may be some internal components that they may be able to replace.

00:10:19So that's where some of them may have underground leaks and some are actually leaking through.

00:10:35I think there were 17 that were on the original list.
00:10:37I think there were about 17 to 20 that were on the list, but I know some of them were, I think, just stuck caps in that so that we've been able to –
00:10:45or the top nuts were stuck, so we've been trying to work through some of those.
00:10:48But I don't have – between all the crews and stuff, I don't have all the lists of which ones have been done up,
00:10:56especially like the northeast ward, which is where most of them are.
00:10:59But I know they've been finding some in the other wards when they've been doing the inspections, too.
00:11:03So they've been kind of working through all of them, but I know we need to get back –
00:11:06So when you say up north, like the coverage, how is the coverage?
00:11:10If anybody up north, how many of them are kind of like next to each other or adjacent?
00:11:18Probably the biggest section is probably up around Pattison.
00:11:25I believe it's Barone.
00:11:27There's about three or four up in that area that I know are bagged right now.
00:11:32So that's probably – we do have some other hydrants that we can go to block over and stuff,
00:11:41but it's one of those things where at this point, if we do get something up in that area,
00:11:46we'll probably take the tanker up with us just to make sure that we actually have adequate water
00:11:51if we don't have a hydrant in that area.
00:11:55So I guess I'm confused because you guys check them, flow, all that stuff, and you bag them.
00:12:03But now you can go back and you can test the ones that you've already bagged to see if they're stuck or –
00:12:10Well, we've got – I guess if we go and flow them, we write down what the issue was with them.
00:12:16And we've got a list and kind of work orders made up that we've also passed on to Tim
00:12:23that say this one's got an underground leak, this one's leaking out the top of the bonnet or something like that.
00:12:29So we know which part of where on the hydrant of that it's actually leaking at.
00:12:36And I know there's probably some of those hydrants that we're having to find whether or not they have shutoff valves,
00:12:43especially some of the older ones that don't have shutoff valves.
00:12:45And so those are going to be obviously a little harder to work on if we can't shut the water off to them.

00:12:54I have one question. It probably won't involve you. I'm not sure.
00:12:58Last time we had a public utility meeting, we talked about some pressure relief hydrants.
00:13:05That's for the water tower.
00:13:07Yeah, but they can be set up in different parts.
00:13:10It's a valve that goes on to the hydrants.
00:13:13Right.
00:13:14But we won't be – I don't think we need those with what we're going to do.
00:13:18I was just thinking if they were down, it would be a good time to be done.
00:13:22True.
00:13:23So are you currently working at getting these repairs made?
00:13:29I mean, we're coming to the end of summer.
00:13:31I see you've got staffing issues as well as Tim does,
00:13:34but obviously with what happened next door we won't be as prepared as a community to support the water flow
00:13:45wherever and wherever we possibly can.
00:13:47Right.
00:13:48So, yeah, we are – I mean, like I said, the guys have been working on –
00:13:51especially if the valves are stuck and stuff, I mean, they've been working to try to break them loose and stuff
00:13:57without potentially creating more problems, though, too.
00:14:02So we've been doing what we can,
00:14:05and I know the guys have been trying to finish up some of the painting, I think, up in the northeast ward, too.
00:14:12But, yeah, I think they've found a few other small problems in the other wards,
00:14:19but I don't think it's been – most of it, I think, has been stuck caps,
00:14:22and so they've been able to take care of most of those.
00:14:28Chief, it might have – obviously we had a fire downtown here that really could have been a lot worse than it was,
00:14:37although it was not good at all.
00:14:40Right.
00:14:41It could have been much worse.
00:14:42Is there anyone in just the best of any adjective I can say to your team, your crew, the fire department,
00:14:54and everybody else that came in that held that to where they did?
00:14:59Are there any – do you want to comment on some of the other departments that came in?
00:15:06I mean, I know for us, having Ada and Mount Victory come in with their aerials,
00:15:14Bell Fountain also came up, and I believe they provided some manpower.
00:15:19I know all the other departments were –
00:15:21that was probably the biggest thing was for us to get some additional manpower
00:15:24to try to keep an eye on things and keep water flowing from as many different places as we could.
00:15:31But it definitely was a – I don't want to say kind of got lucky with that one in the respect that,
00:15:40from what I've been able to see of the structures on either side,
00:15:45those buildings with the High Point Home Health and the barbershop,
00:15:51those common walls that they have with 101 Smokehouse,
00:15:54from what we've been able to see, did not have any breaches or holes in them,
00:15:59which absolutely helped keep it confined to the 101 Smokehouse building.
00:16:05So – and that's kind of one of the things that we're kind of going to be working with the mayor and stuff
00:16:13in terms of trying to get with these downtown businesses and stuff
00:16:16to start doing some fire safety inspections back in them and trying to just –
00:16:22this is the kind of things we're looking for.
00:16:26We may not totally be able to prevent the fire from happening,
00:16:29but if we can keep it from going from business to business to business in that block and stuff,
00:16:34that's the biggest goal that we've got.
00:16:37And so – but, yeah, I can't thank the guys from Mount Victory.
00:16:42I know McGuffey, Forest, Dunkirk, Ridgeway, Bell Center, Richland Township.
00:16:50I mean, all those guys did a phenomenal job of helping our guys out
00:16:55and being able to try to keep it contained to that one building.
00:17:00So I'd definitely say it's definitely something we didn't want to see,
00:17:06but I know we probably could have potentially lost a whole lot more there too
00:17:11if things hadn't gone our way too.
00:17:14And that was a building that had a sprinkler system, at least in the downstairs part,
00:17:19so it's very possible that that helped it from being any worse than what it was too.
00:17:25So definitely a thing we didn't want to see,
00:17:29but one of those things we'll see what happened and we'll learn from it
00:17:36and try to make better from there.

00:17:49I actually have a question for Tim.

00:17:52I believe it's for Tim.
00:17:55So my question's on the street sweeper.
00:17:59Where are we at with the schedule on that?
00:18:01I've seen in the paper, like, Thursday was one side of Columbus, Friday was one side of Columbus.
00:18:07I mean, my quick math on that is if he drives that thing five mile an hour, 25 hours a week,
00:18:12he should cover 126 miles, which should, in theory, cover our 63 miles of road, as it is.
00:18:23Where are we at on the schedule?
00:18:24And I understand we can't get all the cars off the roads,
00:18:27but there's no reason why we can't still sweep the roads as best we can.
00:18:32We want to kind of get on our residents and our businesses to keep their areas clean.
00:18:36And I've only seen it down once.
00:18:41I've seen it out and about.
00:18:43But where are we at as far as the rotation?
00:18:46We pick our trash up once a week for every resident.
00:18:49How come we're not sweeping better, I guess, is my question.
00:18:52I don't want to come across as rude or whatnot.
00:18:56No, don't worry. You did.
00:18:59We do have a schedule, and we alternate awards with the trash pickups.
00:19:05So first award, trash pickup is on Monday.
00:19:10Then Tuesday, Wednesday, Thursday, and so forth through the awards.
00:19:15Then when you also have holidays on top of that, sometimes you get pushed back a day for a trash pickup.
00:19:24So we pushed it back a couple days on each ward to bypass the trash pickup and or the holiday for that.
00:19:35So I should have brought it with me.
00:19:38But I do have a map or a schedule.
00:19:43I think it's Mondays we start in Ward 3.
00:19:46Then Tuesdays we go to Ward 4 and then so on to try to alternate.
00:19:51That's why you don't see it all the time.
00:19:54So you get through each ward each day as the trash does?
00:19:58Not with the trash.
00:20:00No, I'm saying as the trash does.
00:20:02They get through each ward daily.
00:20:04So on his rotation, two days off, he's going to get through the ward each of these days.
00:20:11Currently, he just told me today, we have currently just cleared Ward 3 completely.
00:20:18The other three wards, he's near completion.
00:20:21And we don't try to sweep on the main roads on the beginning of the morning to just a normal day.
00:20:27So Thursdays or Fridays, he does come in early to try to offset the heavy traffic or work traffic that's building up around 7 o'clock, 730 when we start coming in.
00:20:39So he tries to offset that coming in early.
00:20:42And that's when we put the notice for Columbus Street.
00:20:45It's a busy road.
00:20:48It's one of our newest roads we want to try to keep clean.
00:20:52So we asked the people to try to offset the parking so we could try to get down through there to clean that.
00:20:57So we're not just cleaning a quarter mile strip a day.
00:21:02No, I understand that.
00:21:03I mean, I just, for me, I'd like to see him in the residential areas more.
00:21:08He's there every day.
00:21:09And I can get you a map and a schedule to show you where he's going to be.
00:21:14I just wanted to kind of get clarity on how he was rotating and the mileage he was putting in each day type of thing.

00:21:26Tim, the sweeper's been running roughly how long now?
00:21:30I mean, it's only been—

00:21:35Well, one thing I was going to comment, though.
00:21:37That first week or so, is it fair to say that first time through was not as fast as—

00:21:46There was a lot happening.
00:21:48For the first two weeks, I kind of dictated where I wanted him to go.
00:21:52And it was basically Morningside Drive and around the schools.
00:21:57And it's just been probably two weeks now that he's broken off into the wards to do the sweeping in the wards.
00:22:03And, you know, this is not just a typical piece of equipment.
00:22:06You can just jump in and grab the controls and know exactly what you're doing.
00:22:09So the first week, week and a half, it was a lot of learning to do—to basically become one with the piece of equipment.
00:22:17There's a lot of controls on that thing, and it's—
00:22:21I was down there when they rolled that off of the back of the truck.
00:22:25And the guy that was there for the training, he says,
00:22:28I can show you how to drive, but I can't teach you how to sweep because that is an art.
00:22:36It's pretty complicated.
00:22:37Is that what the law does?
00:22:38Yes.
00:22:39And depending on the thickness of the trash that's alongside the road,
00:22:43you're looking at one to three miles an hour max speed.
00:22:47So the five miles an hour is not happening.
00:22:50As bad as the streets were to not be done in the years past,
00:22:55he's going through sometimes twice in the same area to pick up the same thing.
00:23:00You're looking at one to three miles an hour.
00:23:03I appreciate the information.
00:23:05I know we've had it a month, and I knew he had, like, a learning curve and whatnot.
00:23:09I just wanted to get some clarity on where we're at with it as far as coming into the summer.
00:23:13We're getting through it.
00:23:14But, again, for as many years we've been without and the streets have been as dirty as they are,
00:23:19it's not going to be an overnight thing.
00:23:21For sure.
00:23:22So that's the way I want to treat it, too.

00:23:25And just for further knowledge, on the learning curve of operating the equipment,
00:23:30we did spend almost two days up on Kohler Street,
00:23:35and he dumped two hopper loads of dust and dirt and debris that came out of them gutters just off of one road.
00:23:42So there's a lot of stuff out there, and it's not going to get done quick.
00:23:46It's going to take time.
00:23:48And have you trained Sidney Murray on the operation of the equipment?
00:23:51We don't want to do that.
00:23:53But that keeps the job of our store, so I appreciate the work.

00:24:42Yes, so in regards to the fire, I personally want to commend the Public Works Department
00:24:50and the Water Treatment Plant.
00:24:52We called Public Works.
00:24:54They came and got the road shut down around here.
00:24:58About 5 o'clock, we realized maybe we need to make water.
00:25:04We only make water on first and second shifts starting at 730.
00:25:08So we scrambled about.
00:25:10He was on vacation, so we scrambled about and got Jeff Benninger to come in on his day off.
00:25:17He actually was working second shift that day to make water because the tower is running low.
00:25:24You make water.
00:25:25Yes, we make water.
00:25:29Public Works is working with ODOT out on 53 to try to set up some school speed zones
00:25:37and try to get some speed limit changes out there.
00:25:44Project downtown here is about a month behind schedule.
00:25:47They ran into some problems with, I think we talked about this last time, the walls underneath the front of the buildings.
00:25:57Traffic study has started down here.
00:25:59We had another accident today.
00:26:02We did move the speed radar sign down here by Family Dollar.
00:26:09We also put up one of the blinking red stop lights, stop signs here, not lights, signs on Ohio.
00:26:19And the last thing I have is that most wonderful time of every three years, we start negotiations this week.

00:26:40It started at the end of July, July 20.
00:26:44It was right around the last council meeting.

00:27:03How are we getting an accurate depletion of that study when all the traffic is on that side of, there's no main street here of traffic?

00:27:19I personally said, let's wait until we shut that street down and let's do the study.
00:27:23And they're like, no, you need to get some traffic on it.
00:27:27Here's the thing, and I don't know if you want to address this.
00:27:30When we move, when we shut down Detroit Street, there is no traffic light over here.
00:27:36Or on Carroll.
00:27:38So it's going to be the same here as what we've got right now over here.
00:27:45And the truck traffic, this will be what it looks like.
00:27:51Because there shouldn't be many trucks going north and south.
00:27:54That's what it'll look like.
00:27:57If you all keep moving forward with Roundabout, that's what it'll look like, the truck traffic.
00:28:02So that's why they said that gives them a better look.
00:28:11Obviously, a lot of questions about this out there.
00:28:17Not just this topic, but this one in particular, but any topic.
00:28:20I would encourage, as a council member, if you've got a lot of detailed questions, you really want more answers,
00:28:28I know either them or Cindy will bend over backwards to sit down and talk it through with you.
00:28:36Because you do hear things that they don't hear or get questions that they may not get.
00:28:43So we've got to work at this as a team and try to get the best answers.
00:28:50A question I would have that I just wanted is a question for you to think about, and then a follow-up comment would be,
00:29:00one of my concerns at the Ohio-Detroit intersection is not vehicle traffic as much as pedestrian traffic.
00:29:10And trying to get over to Wendy's, for example.
00:29:16And the follow-up would be, as we get more, as ODOT reaches out, if there are things where we can get time to sit down with ODOT
00:29:31or have that opportunity, I'm certain council members would like to be involved with that, too, if they can.

00:31:13It's a different dynamic up here without that light, especially if you have cars parked in front of the filling station and stuff.
00:31:22It is much harder to get out than here.
00:31:26So, you know, I guess right now, if you can take an alternate route, try it.

00:33:41And we went and ate a quick lunch, come back to finish it up,
00:33:44and then seeing more water coming through the road.
00:33:48Our first assumption was maybe the clamps gave loose.
00:33:52So, we worked on removing some of the stone back out
00:33:56and only found out that the water was gushing from another part of the line.
00:34:01So, I always compare it to, like, an old brake line on an automobile.
00:34:05If you understand the brake lines and the weakness,
00:34:09you fix one weak spot and it just moves to the next
00:34:11and it just keeps letting go until you get all the bad out or the whole line is replaced.
00:34:20But the using of the hydrants at that time can also cause additional hammering on the lines
00:34:27and vibrations and stuff.
00:34:30So, we ended up having two brakes that day in the same hole.
00:34:33But there had been some taps there, hadn't there?
00:34:36It wasn't a real healthy section of line right there, was it?
00:34:39No. We ended up old.
00:34:43I mean, it was probably, I don't know,
00:34:45correct me if I'm wrong, about 10 feet or so of line that we chunked out.
00:34:50So, we had a couple old taps that was shut off,
00:34:54but there was a light tap that we had to redo in the process.
00:35:01And again, Council, if you have not seen that, the vac truck is what I call it.
00:35:07I don't know what the proper term is.
00:35:10How long would that job have been if you didn't have that truck?

00:35:18It wouldn't have been.
00:35:20There was no gas line or anything.

00:35:24That line's been there for a while because there was still brick on top of it.
00:35:29And that clay that it was in was so compact that it was like, barely.

00:35:56We cut right down through it, cut underneath of it, minimal shoveling,

00:36:49But this is the time you've got to go for funding, which is crazy.

00:37:05This starts down from Decatur Street and coming down South Wayne.
00:37:10The green is the trunk line now.

00:37:19So, we started to clean that out because it's in the woods
00:37:22and we're getting a lot of I&I.
00:37:24That's where a big chunk that we treat.
00:37:27We treat a lot of river water through this trunk line because it's so old,
00:37:32but it's all along that tree line with the river.
00:37:36Well, we tried to clean it out, and it's just, and then you have,
00:37:40it's all private property, so you've got to get access to all that.
00:37:44It's quite an interesting feat.
00:37:47So, anyway, with all these leaks, there's old siphons,
00:37:50there's all kinds.
00:37:52We thought maybe we should just bring it down Wayne Street.
00:37:56So, this is kind of that project that runs it straight down Wayne Street.
00:38:00So, future-minded, what we're trying to be,
00:38:03is that it's so much easier to maintain, but that is, the green was probably,
00:38:09Burl said it was probably your original main sewer line.
00:38:13A lot of brick.

00:38:15So, every time that river rises, it would just pour in.
00:38:20So, again, this really helps us EPA-wise and all that stuff too,
00:38:27trying to get ahead of that.

00:38:31We'll find out what those sources will be.
00:38:34So, just to keep you in the loop, that's a project that,
00:38:38it may or may not happen, just so you know what we're doing.

00:38:44And that's, basically, you've got all your funding sources,

00:38:52They're all there around the table, and they all take their turn at you,
00:38:56and so it's a place to get it out in front of everybody.

00:39:04they're going to throw it to H2 Ohio and Army Corps too,
00:39:07also gets that same look.
00:39:09And that's where Army Corps gave us $2 million down here for it.
00:39:13So, you know, it's just one of those things we continue to throw out there
00:39:16to see if something sticks, and if it doesn't, we might roll again with it.
00:39:21But it is a pretty substantial issue with our I&I coming into the sewer plant.
00:39:27It makes our sewer plant work extensively hard.

01:00:09As far as the fire, the fire department, tremendous job containing that, thanking the surrounding
01:00:17community fire departments that came to aid in that, the public works, just everybody
01:00:24involved in directing traffic to put it out, it was a tremendous job.

01:01:30barbershop it's probably one of the oldest acting businesses in the city
01:01:34that was his home it's his pride and joy with all his collectibles of the city of
01:01:43Kenton it's fascinating so certainly they set up an account for him out at
01:01:47Quest and again he has no business coming in because he can't get in there
01:01:53to cut hair and he can't move a barbershop because of state law correct

01:02:05I appreciate everyone especially going back to the public hearing. Sometimes the process is
01:02:13tough and really appreciate everyone who of course most of them have left but everyone who was
01:02:21here to bring up questions and all council members for your attentiveness
01:02:26your questions and yeah it's once in a while you get a tough one thrown at you.
01:02:35John had that legislation drawn up and you've got a couple weeks to think that
01:02:40through and while there is no hurry I would echo what John said it has been
01:02:47at a public hearing two times. Now to David's point, if you all decide you want to read a three
01:02:55absolutely fine okay but let's just keep in mind how often it has been brought up
01:03:02and at some point you can only beat it to death so much you're just putting off
01:03:08the tough decision you all have to make but appreciate everyone's focus there and
01:03:14and I know we said it but to echo again Chief Donnelly, KFD, Tim, your crew, Waterworks
01:03:25and KPD I don't think we mentioned that. That was a rough 24 hours and then you
01:03:36throw in the water break and everything that's already going on out here and I
01:03:42just can't say enough about what you all did and I continue to do and and finally
01:03:50was just mentioned I think Robin might have mentioned it just now but if you think
01:03:56that I'll say we as council members get a lot of questions or take a lot of
01:04:04grief sit in these two ladies shoes they're answering questions well that's
01:04:13true and yeah also the traffic on Franklin that day was not kind either
01:04:22that was a dicey place to be but remember the folks that are up here
01:04:28every day so let's let's clarify it that way we get elected and we get to come in
01:04:32here a few times a month more than a few more than a couple but multiple times a
01:04:37month and try to understand and make decisions these folks are here all the
01:04:42time so and they will always answer your questions so with that appreciate
