00:00As part of the release of the names of the senatorial aspirants who have passed and may be included in the ballot in the election of 2025 and other issues,
00:09we will talk to Comelec Chairman George Erwin Garcia. Good morning and welcome to Balitang Hali.
00:15Good morning Sir Rafi and good morning to our fellow countrymen.
00:19How did Comelec determine the 66 senatorial aspirants who may be included in the ballot in the election of 2025?
00:27Sir Rafi, we based that on the provision of the Omnibus Election Code, where Section 69 defines the so-called nuisance candidacies.
00:36And we said, like what we are arguing, we will not disqualify these candidates because of poverty or lack of resources for campaigning.
00:45We said that we will disqualify or cancel a candidate as a nuisance candidate because they cause mockery of the electoral process.
00:54They are making a mockery of the electoral process. Number two, there is no real intention to have a campaign to become a senator.
01:02We based that, Sir Rafi, not only on their Facebook accounts, not only their background, not only the principles that they defend,
01:11if we don't know if they have a political party. Even if they don't have a political party, can they be a serious candidate?
01:19So we put all of that together, Sir Rafi, why we have 66 official but partial list of candidates.
01:29Sir Rafi, 17 were filed yesterday by our law department with petitions to have them declared as nuisance candidates.
01:38Therefore, they will have a chance to explain themselves.
01:42So even the online presence is being watched by the Comelec.
01:45How long will it take before you make a decision on the nuisance and disqualification cases that you mentioned?
01:52How many hearings will it take for the nuisance candidates to defend themselves?
01:58Sir Rafi, according to our estimates and according to the decisions of the Supreme Court, it's enough for them to listen.
02:04We will answer them and after that, we can decide on their cases.
02:09Even if it's a local case, we will adopt the same principle and process.
02:14Aside from calling our Comelec divisions, we will call the respondents.
02:19Expect that in the national and local elections before the end of November this year,
02:24we will be able to issue the decisions on the nuisance candidacies.
02:29Because of our commitment, there should be no nuisance in our ballots because it's a mess and there will be problems.
02:38Sometimes, they will get votes that should be for legitimate candidates.
02:42That's what I'm asking. What effect will it have if the nuisance candidates are included in the ballots?
02:47If they are included, they will be voted.
02:50Later on, if the Comelec or a high court like the Supreme Court says that they are intended to be nuisance candidates,
02:57all the votes given to them will be given to the legitimate candidate.
03:02What if if you vote for the legitimate candidate and the nuisance candidate,
03:07the proclaimed and the winner will be announced?
03:10We will cancel the proclamation when the candidate who was initially proclaimed should lose
03:15and after that, we will proclaim the real winner.

03:25According to the Right to Know Right Now Coalition,
03:28it should not be a nuisance if a big party is no longer in the joint venture.
03:33How is the Comelec trying to comply and to complete the terms of agreement for the election of 2025?
03:39Sir Rafi, St. Timothy is the third joint venture partner of the Filipinos.
03:43Their participation is only financial.
03:46They provided what we call NFCC.
03:49It's like a guarantee that if the Comelec will not be able to pay,
03:52they will have a fund for their commitment to us.
03:56Don't worry because our remaining joint venture partners are capable, able and financially capable
04:03because they submitted to us last Friday their NFCC,
04:08which is also the commitment of the third party that withdrew.
04:15In fact, their NFCC is worth more or less Php20 billion,
04:20while our contract is Php17.88 billion.
04:23They submitted to us a higher contract.
04:27So we have no problem.
04:29At present, we already have almost 78,000 machines, 110,000 machines.
04:36The other peripherals have already been delivered to the Commission on Elections.
04:40So the Comelec is saying that at least on the technical side,
04:42there will be no problem even if their partner withdrew.
