00:22 Jesse Binal is an attorney for President Trump and he joins me now.
00:26 So Jesse, what's the legal strategy when you go to court for the Jan 6 case?
00:33 Well the legal strategy in this case I think is very simple.
00:38 You attack the facts that Jack Smith put out that are wrong.
00:43 For instance, Jack Smith claiming, as you already pointed out, that Donald Trump did
00:49 anything other than call for peace and patriotism on January 6 is wrong.
00:55 And then you attack the law because Jack Smith has the entire law in this case wrong.
01:00 And more importantly, he's ignoring the Constitution of the United States.
01:04 And here's how.
01:06 The First Amendment gives you the right to speech, something that Jack Smith's prosecutors
01:11 are completely ignoring.
01:12 But more than that, it also gives you the right to petition Congress for redress of
01:16 grievances.
01:18 And in this case, when you are saying there was fraud in the election, there were problems
01:22 in the election, and we think you should seat Executives X instead of Electors Y, that's
01:28 something that the First Amendment under the petition clause clearly protects.
01:34 And there are any number of other problems with this case.
01:37 But I think most importantly, Jack Smith is terrified that Donald Trump is going to be
01:45 elected again.
01:46 Because Jack Smith is actually the one terrified of democracy, because democracy would bring
01:50 accountability for him and quite honestly, his out of control prosecutors and an out
01:55 of control Justice Department.
01:56 When you guys are brought this case in Washington, D.C.
01:59 Yeah, I mean, everybody knows that's a joke.
02:01 You'll probably try to take a motion to move venues.
02:04 When you do, though, go to trial, are you going to be putting the 2020 election on trial?
02:10 What will that look like?
02:12 Well, I'm not part of the trial team on this.
02:16 He's got some excellent lawyers on this, including John Loro, is going to, I think, be able to
02:24 put together a great case for this.
02:27 But when they do go to trial, they absolutely, the government has opened up the 2020 election
02:34 in their indictment within the text of the indictment themselves.
02:38 So you bet Donald Trump is going to have a case to show the irregularities and the fraud
02:44 that was in the election.
02:45 He can do that.
02:46 All right, Jesse, good luck.
02:47 And I think that's a but but let me let me also say this case should never make it to
02:52 a trial.
02:53 This case should be dismissed.
02:54 And there's strong arguments to dismiss this case.
02:56 All right.
