00:00 In a federal criminal trial,
00:01 the judge is assigned randomly.
00:03 And so for Donald Trump,
00:05 who's going to be facing the
00:06 biggest threat ever in his life
00:08 coming up very soon, it could go
00:10 one of a couple different ways.
00:11 He could get a judge that he
00:13 himself appointed, like Eileen
00:15 Cannon has previously sort of had
00:16 his back in the classified
00:18 documents case, he could have that.
00:19 Or on the other hand,
00:21 he could have what he got,
00:22 which is a judge who probably is
00:24 not going to be super big fan of
00:26 him.
00:26 This is US District Judge
00:29 Tanya Chutkin.
00:30 We don't know everything that she
00:32 believes about everything.
00:34 And in terms of her record and
00:36 her education seems eminently
00:38 qualified to do this and
00:39 seems to be a person of great
00:41 integrity.
00:43 I'm just saying there are a few
00:44 details that don't necessarily hint
00:47 that this is going to go super easy
00:49 for the big guy.
00:50 So back in 2021,
00:51 she actually has previously dealt
00:53 with Trump in the legal world.
00:55 She was the judge, and
00:57 you might recall this,
00:58 who denied his 2021 motion to halt
01:00 records for being turned over
01:02 the January 6 committee writing,
01:04 presidents are not kings and
01:06 plaintiff is not president.
01:07 >> Ooh.
01:08 >> Which is just, just love it.
01:11 I remember that quote,
01:12 I didn't remember her name, but
01:13 I remember that quote and
01:14 that was good.
01:15 She was appointed to the US
01:16 District Court for
01:18 the District of Columbia in 2014 by
01:20 President Obama.
01:22 >> Thanks Obama.
01:22 >> I don't think Obama and
01:24 Trump have ever clashed in any way.
01:26 So that doesn't matter.
01:28 >> But yeah, thank you.
01:28 >> They have nothing to do with one
01:29 another, all right?
01:30 >> No, I don't think he's
01:31 supposed to be, no.
01:32 >> Let's not talk about it.
01:33 There's just no correlation from
01:35 Obama to Trump.
01:36 >> Yeah. >> My God,
01:38 we'll be talking about it forever.
01:39 >> Nothing, anyway, so in terms of
01:41 all of the different cases that
01:44 have been going on around January
01:46 6 so far, Chuck has been involved
01:48 in a number of them.
01:49 And has apparently set tougher
01:51 sentences than requested by
01:53 the DOJ in a number of cases
01:54 involving defendants on January 6.
01:57 Citing the necessity of
01:58 consequences for
01:59 taking part in the insurrection.
02:01 As of last month,
02:02 Judge Chucken has overseen 31
02:04 convicted January 6 rioters.
02:07 In nine cases, she went above
02:08 the recommended sentencing.
02:10 She matched the recommendations 14
02:12 times, and with misdemeanors in
02:14 which the prosecution was not
02:16 seeking jail time, she still
02:18 sentenced jail time between 14 and
02:20 45 days.
02:21 For some context, other judges have
02:23 gone with the recommended sentencing
02:26 80% of the time.
02:28 So a little bit of a gap there,
02:30 of course, some degree of
02:31 discretion is up to the judge.
02:33 So she hasn't done anything wrong
02:35 in that case.
02:35 And if she believes that there have
02:37 to be consequences, which she says
02:39 there do have to be consequences
02:41 for participating in an attempted
02:43 violent overthrow of the government
02:45 beyond sitting at home.
02:46 That doesn't mean that necessarily
02:48 she would feel the same way about
02:49 Trump who is not storming
02:51 the barricades.
02:52 He was just impotently trying to
02:54 choke out a Secret Service agent in
02:56 a limo.
02:56 So maybe this doesn't mean
02:58 anything, Francesca, but
02:59 what do you think?
03:00 >> I mean, judge chucking him
03:02 behind bars.
03:04 [LAUGH] I think we got ourselves
03:06 a winner here.
03:07 She is perfect for the job,
03:09 if I do say so myself.
03:11 And if any of us have any hope of
03:13 seeing him serve even community
03:16 service, y'all, let's just watch
03:19 him pick up some dirty diapers by
03:22 the side of the road.
03:24 I would love to see that.
03:24 >> How did they get there?
03:25 [LAUGH] >> I don't know why they're
03:27 there, but they're there, right?
03:28 >> Mm-hm.
03:30 >> I think this is our judge.
03:32 I think this is the closest we're
03:34 going to get, and Obama striking
03:37 from beyond the presidency.
03:40 >> Okay, Obama, yeah, thanks,
03:41 Obama, he's given us,
03:42 this is like two things now.
03:44 Good, hey, he hit two, good.
03:45 Awesome, anyway, no, I'm kidding.
03:48 But anyway, with that said,
03:49 that's the judge.
03:51 This is just our belief.
03:52 Obviously, Trump deserves a fair
03:55 trial, and when he gets that fair
03:57 trial, he will pretend that it's not
03:59 a fair trial, but he deserves it
04:02 anyway, as everyone does.
