00:00 We will give answers to legal and legal questions.
00:04 Let's find out the heart of the law,
00:06 Athorney Gabby Concepcion.
00:08 Athorney?
00:09 Hey, Anne Sue.
00:11 Our topic today is trending and talked about again.
00:15 You've probably watched this already.
00:17 That's too much.
00:27 That's too much.
00:28 So, have you watched this already?
00:35 A lot of people have watched this, right?
00:37 But what they're saying in this video is that
00:40 there's a teacher who didn't get a news that he got a news while he was live-streaming.
00:45 What does the law say about that?
00:47 Well, here's all you need to know.
00:49 Ask Attorney Gabby.
00:51 [music]

00:59 Oh, Athorney, is it really prohibited for a woman to do this in a video
01:03 even though she didn't show her face in her live-stream?
01:07 Well, it looks like that situation where a teacher is serving his students
01:12 and it's already insulting to the humanity of the children.
01:16 Well, it's like it's prohibited in the Child Protection Policy of DepEd
01:20 that should be followed not only by public schools but also private schools.
01:26 We should really investigate and know what happened and if this will happen again.
01:32 Because even in Republic Act 7610, our Anti-Child Abuse Law,
01:38 insulting or talking to a child who is hurting his dignity or self-confidence
01:46 can be a form of child abuse.
01:48 Even if it's said that there's a joke or an instigation from the student,
01:53 maybe the student is bullying the teacher,
01:56 our expectation is that the older one will be more likely to be in this situation.
02:02 They say, "If they go low, we go high."
02:05 Be the better person as a teacher.
02:07 Let's teach the children the right way to get angry.
02:11 It's prohibited to insult the fellow at all times, especially if it's our teacher.
02:16 [music]

02:20 What if a person doesn't know that they're being videotaped or live-streamed?
02:28 Can they be punished for doing this?
02:31 The answer is, generally, it's a violation of privacy to record and upload situations
02:37 that have an expectation of privacy, especially if it's damaging to a person's reputation.
02:44 Even if a person is doing something wrong, especially if it's a private person,
02:48 they should go through the right process of complaining to the right authority.
02:52 We also have the Anti-Wiretapping Act, remember?
02:55 For example, if there's a private communication,
02:57 all people who are involved in that conversation cannot record or tape it.
03:04 The use of a person's name, picture, or voice,
03:08 or considered personal information, can also be a violation of our Data Privacy Law.
03:14 There are possible criminal and civil cases for damages under the Civil Code.
03:20 So don't just upload videos, and even if you can erase it,
03:24 it might spread and the damage will be done.
03:28 As the saying goes, "The school is the second home of the students."
03:32 So we should not just teach knowledge, but how we can care for each other.
03:39 As long as we talk about the law, we will make it clear.
03:43 For the peace of mind, don't think twice.
03:47 Ask Attorney Gaby.
