00:00 because we had some breaking news here Tuesday,
00:02 and that is eight counts completely dismissed
00:05 against Jack Jones.
00:06 The felony charges have been dropped,
00:08 and his penalty as agreed between his camp,
00:10 including his defense attorney, Rosemary Scappiccio,
00:13 and the district attorney's office of Suffolk County,
00:16 is that he will have one year of pretrial probation
00:19 and 48 hours community service.
00:21 That's it.
00:22 For all the discussions we had on this podcast,
00:24 which were a lot, and nuanced, I thought,
00:26 and reasonable, and backed by 10 to 12 defense attorneys
00:30 that I spoke to, there was a real issue for him,
00:34 that there were mandatory minimum sentences.
00:35 And I'll make this quick,
00:36 because I talked to some of those attorneys
00:38 after this broke and got it confirmed.
00:40 And I'll just read some quotes,
00:41 because this is their analysis.
00:43 I don't know how much this is worth in the media world
00:45 when it comes to criminal justice.
00:47 In the sports world,
00:48 this is the shit that we live for on Twitter.
00:50 Here's what their analysis was of that penalty.
00:52 Again, this is a guy who could have gone to jail, prison,
00:55 mandatory sentences, all washed away.
00:57 Quote, wow.
00:58 Quote, Rosie, she's excellent.
01:00 This was the issue all along,
01:02 proving to a jury that the defendant knew
01:03 they possessed the firearm, the state couldn't do it,
01:05 that's why they dismissed the charges.
01:07 Here were the good ones.
01:09 Quote, that's the biggest load of horse shit I've ever seen.

01:14 Another one, that's what you call a home run
01:16 in that same person, but you run out of characters.

01:28 Anyway, that person added, this is, you know,
01:30 being on third base, born there,
01:32 and thinking you hit a triple.
01:34 So on the football side,
01:37 I'm not really interested yet in getting there,
01:38 but Jack Jones is back.
01:40 He's gonna play for the Patriots.
01:41 He should be available week one.
01:42 And his attorney, Rosemary Scappiccio said that, you know,
01:46 he's gonna play football full time
01:47 and that's all that he wanted.
01:49 And here we are.
01:50 So your thoughts, just real quickly on Jack Jones,
01:51 and then we'll get to hopefully
01:53 making the people some money.
01:54 - Yeah, I just think following the story
01:55 through guys like you and Karn and others,
01:57 I thought there was no chance this was the result.
01:59 Okay, and not just you guys, but legal experts.
02:01 I mean, you're a football expert,
02:03 but you were quoting legal experts
02:06 when you guys were covering this.
02:07 I thought that in the range of outcomes,
02:09 a five, 10% outcome, where it was like 80%,
02:12 he would miss a big chunk of the season.
02:15 And there's probably some percentage
02:16 where he does end up in jail.
02:18 I guess based on the text that you tweeted out today,
02:20 people you talked to,
02:22 there's some sentiment that the DA
02:24 should have gone harder at this,
02:26 that maybe because he's celebrity.
02:28 Is the feeling, Andrew, people you talked to, the experts,
02:31 is celebrity status may have affected
02:32 the way they went after him?
02:33 Did you get that sense today?
02:34 - That was the sense from people I talked to.
02:37 Now, granted, the only people I talked to,
02:39 at least tonight, and I talked to an ex-judge
02:42 for a long story I wrote back in June,
02:43 just mapping out, okay, here are all the possibilities
02:45 and the likelihoods.
02:46 You know, these are defense attorneys
02:48 who would root for this kind of outcome.
02:49 That people who worked in these courts
02:51 and cases and had them tried in Suffolk County
02:55 and look and go, I wish the DA's office
02:57 would treat me like that,
02:59 because they saw celebrity from the start
03:01 as being a major factor here.
03:02 Now, ultimately, because Jack Jones
03:04 didn't have the guns on his body or in his car,
03:09 that element comes into play
03:10 where you have to prove that he knew they were there.
03:12 Being in a bag does not count
03:13 in the state of Massachusetts as being in your possession.
03:16 And that was the big issue for the state.
03:17 But as far as that went, again, given the severity
03:20 of the sentences and the punishments
03:21 that typically come along with these charges,
03:24 yeah, they were shocked.
03:25 And so there are people that root for this
03:27 and we're also upset that it happened this way.

04:13 I listened to the segment today on 985 The Sports Sub
04:15 about can Patricia come in and slow down Mac Jones?
04:18 One to 10, one being no impact at all,
04:21 10 being this is the biggest game changer in Sunday's game.
04:25 Patricia being on the Eagles coaching staff,
04:27 the impact in the game in your mind, one to 10.
04:31 - So in my mind, I would have said a five
04:35 and the people that I've spoken to have that much lower.
04:39 And it's not even really anything to do with Mac.
04:42 It's more to do with how is Bill going to counter
04:45 the Eagles run game and the techniques involved.
04:48 Forget like manners on coverage
04:49 or what they like to do on third down.
04:51 Like there's a great confidence in that building.
04:52 We're a game plan team.
04:54 It doesn't matter.
04:55 You can't predict what we're going to do.
04:56 Even if you're someone who learned at Belichick's knee,
04:59 knows how Belichick thinks because that's how he thinks.
05:01 And as Bill O'Brien told us today
05:03 on a conference call with reporters,
05:05 that Matt Patricia taught him how to think
05:07 as a quality control assistant when he came in in 2007
05:11 and worked under Patricia.
05:13 So there's a lot there.
05:14 I would just say, read the column again,
05:16 still fleshing part of that out.
05:17 I do want to give folks actually one note on Jack Jones
05:19 because I say, I don't care from the football aspect of it.
05:22 I think the criminal stuff is more pertinent right now.
05:25 We're going to get to football.
05:26 He's going to play though.
05:26 The league could still suspend them.
05:28 They're not beholden to the criminal systems,
05:32 results or their processes.
05:34 - Any, so let me jump, stop it.

05:37 or how they'll adjudicate?

05:41 I know my colleague, Doug Kite has done the same
05:44 and just nothing.

05:46 And the Patriots do not intend to release a statement.
05:47 Belichick will, spoiler alert, stiff arm all of us tomorrow
05:51 and just say, we're onto the Eagles.
05:52 So the thing about Jack Jones though,
05:56 not only do you feel better about cornerback
06:00 where in the last episode I had with James White,
06:02 I'm going, I don't know what they do if he's out
06:03 and it's Christian Gonzalez and Jonathan Jones,
06:05 Marcus Jones, five foot eight, really good player.
06:07 Not a great outside corner, might be that guy.
06:10 He not only gives you better depth,
06:11 he gives you more scheme flexibility.
06:14 They can play more man coverage with Jack Jones,
06:16 apparently on the roster this season,
06:19 at least to start or maybe the whole year
06:21 than they could have if it was just a rookie
06:23 and Jonathan Jones, who we all saw, did his best
06:26 but struggled to cover the league's best receivers
06:28 because they're the league's best receivers
06:30 and Jonathan Jones is not among the league's best corners.
06:32 So that's, it's a good thing in multiple ways
06:34 that Jack Jones is back and that's my analysis.
